NOTICE OF SALE UNDER POWER

STATE OF GEORGIA

COUNTY OF TURNER

Because of a default in the payment of the indebtedness secured by a Security Deed executed by Beatrice Vega to Talbot State Bank dated July 16, 2008, and recorded in Deed Book 224, Page 75-77, Turner County Records and re-recorded in Deed Book 225, Page 799-801, Turner County Records, securing a Note dated July 16, 2008 in the original principal amount of $70,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said Deed, will on the first Tuesday, December 4, 2012, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to wit:



All that tract or parcel of land lying and being Ten (10) Acres, more or less, of Land Lot Number Two Hundred Thirty-One (231) in the Thirteenth (13) Land District of Turner County, Georgia, described as follows: Begin at a point on the South boundary of a county maintained dirt road, which point is 993 feet measured along the South boundary of said road from the original northwest corner of said Land Lot Number 231; thence continuing along the South boundary of said county maintained dirt road (along the center line of which runs the original north land lot line of said land lot) 2057 feet to the original northeast corner of said land lot; thence southerly and along the East land line of said Land Lot 212 feet to a point; thence westerly and on a course parallel with the South boundary of said county maintained dirt road 2057 feet to a point; thence northerly and on a course parallel with the West land lot line of said lot a distance of 212 feet to a point on the South boundary of said county maintained dirt road which is the point of beginning, together with all improvements thereon situate.



LESS AND EXCEPT:

All that tract or parcel of land lying and being 0.292 acres, more or less, of Land Lot Number 231 in the 13th Land District of Turner County, Georgia, described as follows: BEGIN at the northeast corner of said Land Lot Number 231; thence southerly and along the east land line of said land lot a distance of 212 feet; thence westerly and on a course parallel with the north land lot line of said land lot a distance of 60 feet; thence northerly and on a course parallel with the east land lot line of said land lot a distance of 212 feet; thence easterly and along the north land line of said land lot (the center line of a county maintained road runs along the original north land line of said land lot) a distance of 60 feet to the northeast corner of said land lot which is the POINT OF BEGINNING. This tract is for the purpose of ingress and egress from the county maintained road (C.R. # 159 aka Alberson Road) along the north land lot line of Land Lot 231 to the 168 acres, more or less, of Land Lot Number 231 in the 13th Land District of Turner County, Georgia. (

Said property is known as 1744 Alberson Road, Ashburn, GA 31714, together with all fixtures and personal property attached to and constituting a part of said property, if any.



Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.



The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.



Notice has been given of intention to collect attorney s fees in accordance with the terms of the Note secured by said Deed.

Said property will be sold as the property of Beatrice Vega, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of Beatrice Vega or a tenant or tenants, and the proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale, including attorney s fees, all as provided in said Deed, and the balance, if any, will be distributed as provided by law.
