NOTICE OF SALE UNDER POWER, TURNER COUNTY

Pursuant to the Power of Sale contained in a Security Deed given by Rico M Harley to Mortgage Electronic Registration System, Inc. as nominee for Taylor, Bean & Whitaker Mortgage Corp. dated 10/4/2006 and recorded in Deed Book 209 Page 540, TURNER County, Georgia records; as last transferred to BANK OF AMERICA, N.A., SUCCESSOR BY MERGER TO BAC HOME LOANS SERVICING, LP FKA COUNTRYWIDE HOME LOANS SERVICING, LP by Assignment filed for record in TURNER County, Georgia records, conveying the after-described property to secure a Note in the original principal amount of $ 123,068.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of TURNER County, Georgia, within the legal hours of sale on the first Tuesday in September, 2012 (September 04, 2012), the following described property:



All that tract or parcel of land lying and being known as Lot 4 of the Ashburn Meadows Subdivision located in Land Lot 141 of the 2nd Land District, City of Ashburn, Turner County, Georgia, and being more particularly described as follows: To find the point of beginning, commence at the intersection of the south right of way line of Hill Street (47' R/W) with the west right of way line of Meadows Lane (60' R/W) and from said point of reference run thence south 63 16'09" west and along the south right of way line of Hill Street 281.04 feet; run thence south 27 11'00" east 270.00 feet to the point and place of beginning. From said beginning point, run thence north 64 10'05" east 268.80 feet to a point located on the west right of way line of Meadows Lane; run thence along the arc of a curve a distance of 111.81 feet (said arc being subtended by a chord having bearing of south 15 37' 05" east, a distance of 111.74 feet, and a radius of 897.57 feet); run thence south 64 10' 05" west 246.39 feet; run thence north 27 11' 00" west 110.00 feet to the point and place of beginning. All as is more particularly shown and described as Lot 4 on that Plat of Survey prepared for Ashburn Meadows by Sunbelt Surveyors, Inc. dated November 25, 2005. Said plat and the description thereon, which is incorporated into this description by reference thereto, is recorded in Plat Book B69, Page 9, of the Turner County Superior Court Clerk's Office Plat Records. (



The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney s fees (notice of intent to collect attorney s fees having been given).



Said property is commonly known as 132 Meadow Lane, Ashburn, GA 31714 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): Rico M Harley or tenant or tenants.



Said property will be sold subject to: (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) the right of redemption of any taxing authority, (c) any matters which might be disclosed by an accurate survey and inspection of the property, and (d) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.



The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed. Pursuant to O.C.G.A. Section 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and non-judicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided immediately above.
