Smith to Wells Fargo Home Mortgage, Inc., dated January 22, 2003, recorded in Deed Book 313, Page 980, Morgan County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED SIX THOUSAND FIFTY AND 0/100 DOLLARS ($106,050.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Morgan County, Georgia within the legal hours of sale on the first Tuesday in September, 2012, the following described property:

Brewer, GA RLS, which plat is incorporated herein and made a part hereof by reference hereto and being particularly described as follows: To arrive at the Point of Beginning, begin at a point where the northeasterly right of way of Prospect Road (80 foot right of way) and the westerly right of way of Bostwick-Fairplay Road (80 foot right of way) join; thence running South 49 feet 23 minutes 37 seconds East a distance of 135.5 feet to a point on the northerly right of way of Prospect Road and the true point of beginning; from said true point of beginning running thence along the northerly right of way of Prospect Road North 50 degrees 33 minutes 10 seconds West a distance of 177.47 feet to a point; thence continuing along the northerly right of way of Prospect Road north 50 degrees 27 minutes 19 seconds West a distance of 142.23 feet to a point; thence continuing along the northerly right of way of Prospect Road north 50 degrees 55 minutes 04 seconds West a distance of 113.40 feet to a one-half inch rebar set on the northerly right of way of Prospect Road; thence running North 44 degrees 52 minutes 55 seconds East a distance of 167.49 feet to a 3/4 pipe found; thence running South 50 degrees 29 minutes 00 seconds East a distance of 433.00 feet to a 3/4 inch pipe found; thence running South 44 degrees 52 minutes 55 seconds West a distance of 166.48 feet to a point on the northerly right of way of Prospect Road and the True Point of Beginning. This being the same property transferred from Maxie Conner and R. Louis Herndon to John J. Harris, Jr. and Sharon P. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney s fees (notice of intent to collect attorney s fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
