12-1007L NOTICE OF SALE UNDER POWER STATE OF GEORGIA, COUNTY OF SPALDING By virtue of a power of sale contained in a security deed given by Kyle D. Johnson to Georgia Banking Company, dated March 19, 2008, recorded in Deed Book 3230, Pages 209-219, Spalding County, Georgia Deed Records, conveying the after described property to secure a Promissory Note in the original principal amount of ONE HUNDRED FIFTEEN THOUSAND AND NO/00 ($115,000.00) DOLLARS and any renewals, fees, extensions, or additional advances, with interest thereon as set forth therein plus all additional indebtedness and future indebtedness, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Spalding County, GA, within the legal hours of sale on the first Tuesday in August, 2012, the following described property: All that tract or parcel of land lying and being in the City of Griffin, Spalding County, Georgia, being Lots 7, 8, 9, & 10 of Morris Heights per plat thereof recorded in Plat Book 3, Page 365 Spalding County, Georgia, records, being improved property formerly known as No. 124 Oak Lane. This being the same property conveyed by Warranty Deed from Reginald Hawthorne to Harry W. Burkhalter and Sandra S. Burkhalter dated September 28, 1998 and recorded in Book 1581, Page 331, in the Office of the Clerk of Superior Court, Spalding County, Georgia. NOTE: Said property is presently known as 824 White Street, f/k/a 124 Oak Lane, according to the street numbering system of the City of Griffin, Georgia. The above-described property is conveyed subject to any covenants and restrictions of record affecting said property. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed as well as all other indebtedness owed to Lender. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
