12-9911 12-07786 Crawley 11/22.29;12/6.13.20.27 NOTICE OF SALE UNDER POWER GEORGIA, CARROLL COUNTY Because of default in the payment of the indebtedness, secured by a Security Deed executed by Sarah Crawley to Mortgage Electronic Registration Systems, Inc. as nominee for Embrace Home Loans, Inc., its successors and assigns dated December 10, 2010 in the amount of $151,015.00, and recorded in Deed Book 4855, Page 36, Carroll County, Georgia Records; as last transferred to Embrace Home Loans Inc by assignment; the undersigned, Embrace Home Loans Inc pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, and pursuant to O.C.G.A. Googe", prepared by Eston Pendley & Associates, Inc., Registered Land Surveyors, verified by Eston Pendley, Georgia Registered Land Surveyor No. 945, under date of March 21, 1980, which said plat is recorded in Plat Book 24, Page 50, Carroll County, Georgia Records which plat and the record thereof are each specifically by reference incorporated into this description, being that same parcel of land described in that certain Warranty Deed from Hubert J. Sewell, Jr., to Thomas l. Googe, dated April 24, 1980, recorded in Deed Book 406, Page 245, Carroll County Georgia Records, said property having situated hereon and entirely within the boundaries thereof in the year 1983, one masonite siding dwelling and other improvements; and the above property is specifically described as follows: Beginning at a point on the South side of GA. Hwy. 5 at the center of Yellow Dirt Creek and highway Right-of-Way; thence Southeasterly along and of creek 503.5 feet more or less; thence Southwesterly South 50 Degrees 31 Minutes West 241.1 Feet more or less to an iron pin; thence Northwesterly North 52 Degrees 2 Minutes West 517.4 Feet more or less to an iron pin on the South side of GA. Hwy. 5 on Right-of-Way; thence Northeasterly along Right-of-Way 296.6 Feet more or less to the Point of Beginning; and being the same property conveyed to Mary Googe, individually, by Executrix`s Deed Dated June 26, 1985 and recorded June 27, 1985 of record in Deed Book 499, Page 158 and further conveyed to Mary G. Duncan and Charles Freddie Duncan, by Warranty Deed dated July 1, 1996 and recorded July 3, 1996 of record in Deed Book 930, Page 684, Carroll County, Georgia Records. which has the property address of 1837 E. Highway 5 , Carrollton, Georgia., together with all fixtures and other personal property conveyed by said deed. The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed. Notice has been given of intention to collect attorneys' fees in accordance with the terms of the note secured by said deed.
