13-0041L NOTICE OF SALE UNDER POWER GEORGIA, SPALDING COUNTY Under and by virtue of the Power of Sale contained in a Note and Deed to Secure Debt and Security Agreement given by Raphia, Inc. to Global Commerce Bank, dated November 14, 2005, and recorded on November 17, 2005, in Book 2799, Page 147, in the Office of the Clerk of the Superior Court for Spalding County, Georgia, conveying the after described property to secure a certain Note for the indebtedness, with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Spalding County, Georgia, within the legal hours of sale on the first Tuesday in February, 2013 the following described property: ALL THAT TRACT OR PARCEL OF LAND lying and being in Land Lot 157 of the 3rd Land District of Spalding County, originally Henry County, Georgia, containing 1.635 acres, as per plat of survey for Joel G. Thrailkill, dated February 26, 1998, by Gerald H. Bernhard, Georgia Registered Land Surveyor #2688, and being more particularly described as follows: To find the true point of beginning, begin at a point located at the intersection of the west right of way of McIntosh Circle and the southerly side of the right of way of East McIntosh Road (60 foot right of way); thence in a westerly direction along the southerly side of the 60 foot right of way of East McIntosh road, a distance of 222.80 feet to a 1/2" rebar found, which is the true point of beginning; thence south 00 degrees, 06 minutes, 00 seconds East, a distance of 388.10 feet to a 1/2" rebar found; thence North 87 degrees, 08 minutes, 00 seconds West, a distance of 262.96 feet to a 1/2"rebar set on the easterly side of the right of way of North Hill Street (50 foot right of way); thence along the easterly side of the 50 foot right of way of North Hill Street north 22 degrees, 57 minutes, 58 seconds east, a distance of 100.00 feet to a point; thence north 08 degrees, 51 minutes, 42 seconds east a chord distance of 121.08 feet (arc distance of 122.57 feet and having a radius of 226.63 feet) to a point; thence leaving the easterly side of the 50 foot right of way of North Hill Street and proceeding south 89 degrees, 58 minutes, 52 seconds east, a distance of 21.89 feet to a 1/2" rebar found; thence north 28 degrees, 27 minutes, 22 seconds east, a distance of 176.78 feet to a 1/2" rebar found on the southerly side of the 60 foot right of way East McIntosh Road; thence north 85 degrees, 26 minutes, 37 seconds east a distance of 98.47 feet to a 1/2" rebar found and the true point of beginning. Subject to all superior encumbrances, easements, right of ways, liens, matters and agreements of record. The debt secured by said Deed to Secure Debt and Security Agreement has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in said Note and Deed to Secure Debt and Security Agreement. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in said Deed to Secure Debt and Security Agreement and by law, including attorney s fees, notice of intent to collect attorney s fees having been given. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to said Deed to Secure Debt and Security Agreement set out above, with the Note and Deed to Secure Debt and Security Agreement originally made to Global Commerce Bank, now having been held by the Federal Deposit Insurance Corporation ( The FDIC ), as receiver of Global Commerce Bank.
