13-0167L NOTICE OF SALE UNDER POWER GEORGIA, SPALDING COUNTY Because of default in the payment of the indebtedness, secured by a Security Deed executed by Eric E. Schmitt to Mortgage Electronic Registration Systems, Inc. as nominee for First Horizon Home Loans, a Division of First Tennesse Bank N.A., its successors and assigns dated February 29, 2008 in the amount of $40,000.00, and recorded in Deed Book 3226, Page 47, Spalding County, Georgia Records; as last transferred to JPMorgan Chase Bank, National Association by assignment; the undersigned, JPMorgan Chase Bank, National Association pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, will on the first Tuesday in March, 2013 , during the legal hours of sale, at the Courthouse door in Spalding County, sell at public outcry to the highest bidder for cash, the property described in said deed to-wit: All that tract or parcel of land lying and being in Land Lot 129 of the 3rd District, on the Southwesterly side of Hallyburton Street in the City of Griffin, Spalding County, Georgia, which may be more fully described with reference to a plat of survey made September, 1941, by N.S. Westbrook, C.E., and recorded in Plat Book 3, Page 201, Spalding County Records, said plat together with the metes, bounds, courses and distances shown thereon is incorporated by reference and made a part hereof as fully as if set out herein, said lot may be more particularly described by metes and bounds as follows: beginning at an iron stake on the Southwesterly property line of Hallyburton Street, which said Point of Beginning is 213 feet Northwesterly from the intersection of the Southwesterly property line of Hallyburton Street with the property line of 12th Street, and from said beginning point, North 43 degrees 10 minutes West a distance of 65 feet along the Southwesterly property line of Hallyburton Street to an iron stake; thence South 30 degrees 45 minutes West a distance of 115 feet, more or less, to an iron stake; thence South 43 degrees 10 minutes East, 65 feet, more or less, to an iron stake; thence North 30 degrees 45 minutes East 115 feet, more or less, to Hallyburton Street, the Point of Beginning. The above described property is bounded, now or formerly as follows: Westerly by the property of Sally Partin; Southerly by property of Croft Brannon; Easterly by property of Mrs. Annie Geon; and Northwesterly by Hallyburton Street. Located on the above described property is a dwelling known and designated as House No. 616 Hallyburton Street. Subject to any Right-of-Way deeds or other easements of record. which has the property address of 616 Hallyburton Street, Griffin, Georgia., together with all fixtures and other personal property conveyed by said deed. The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed. Notice has been given of intention to collect attorneys' fees in accordance with the terms of the note secured by said deed. Notice has been also given, in writing and by certified mail, return receipt requested, to the borrower, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the note thereby secured in accordance with O.C.G.A.
