NOTICE OF SALE ESTATE OF AMOS GRAGG

Hazel McTaggart and Dwight Tucker, the duly appointed administrators of the Estate of Amos Gragg, hereby give public notice that an auction sale of personal property, furniture, furnishings and household goods will be held on July 28, 2012 to commence at 8:30 o?clock a.m. until all assets have been sold. Public viewing of the personal effects will begin at 8:00 a.m. on said date at 84 Farmer Road, Toccoa, Georgia.

Real estate, consisting of about 4 acres of land, the residence at 84 Farmer Road, Toccoa, Georgia, as well as, outbuildings will be open for written bids until July 28, 2012 at 12:00 noon at which time final bids will be taken for the real property at the homeplace at 84 Farmer Road, Tocoa, Georgia. Written bids must be submitted to Robert A. Johnson, Attorney at Law, P.O. Box 6108, Elberton, Georgia 30635; the final accepted bid will be the highest and best offer received; the bid, if acceptable to the Administrators, is subject to approval of the Probate court of Stephens County. The successful bidder will be required to submit 15% of the purchase price as Earnest Money and will be required to close within 30 days of approval of the Contract by Stephens County Probate Court. The Estate will provide a limited warranbty deed to the property.

Taxes for the current year will be prorated at time of closing.

The property shall onsist of all lands currently titled in Amos Gragg located at 84 Farer Road, Toccoa, Stephens County, Georgia; see Tax Map 020D, parcel 021, records of Stephens County tax Assessor.

CALL FOR SPECIAL ELECTION

GEORGIA, STEPHENS COUNTY:

I, Theresa Kelley, SUPERINTENDENT OF ELECTIONS for the above State and County, DO HEREBY CERTIFY THAT:

WHEREAS, in the 2010 Georgia General Assembly, the House and Senate passed House Bill 277, known as the Transportation Investment Act of 2010, to provide 12 special tax districts across the State and to provide for a special district transportation sales and use tax in such special districts; and

WHEREAS, in accordance with Code Section 48-8-243 of the Transportation Investment Act of 2010, the Georgia Mountains special district Roundtable, of which Stephens County is a part, officially approved a Final Investment List to be funded through the special district transportation sales and use tax; and

WHEREAS, the special one percent (1%) sales and use tax will not exceed a projected revenue generation amount of $1,259,664,582 for the Georgia Mountains special district, and shall not exceed ten (10) years in duration commencing January 1, 2013; and

WHEREAS, Seventy-Five percent (75%) of the projected revenue generation amount will fund the approved Final Investment List of the Georgia Mountains special tax district and Twenty-Five percent (25%) of the projected revenue generation amount will be directly distributed to the cities and counties of the Georgia Mountains special tax district by formula for local transportation uses; and

WHEREAS, the Georgia Mountains Roundtable has made a resolution to the Superintendents of Election of the Georgia Mountains special tax district, as specified in the Official Code of Georgia Annotated 48-8-244, to notify the election superintendent to issue the call for election for the purpose of submitting to the electors of the county the question of whether such sales and use tax shall be granted for approval or rejection; and

WHEREAS, in accordance with Code Section 48-8-244, the election results will be tabulated per district and if more than one-half of the votes cast throughout the special district are in favor of levying the tax, then the tax will be levied in said special district as specified; and

WHEREAS, the Final Investment List to be undertaken and completed utilizing 75% of the projected revenue generation amount in the Georgia Mountains special tax district are as follows:

NOW, THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME BY VIRTUE OF O.C.G.A. ?48-8-244 AND O.C.G.A.?21-2-540, IT IS HEREBY ORDERED:

(1) That a call for a special one percent (1%) sales and use tax in the Georgia Mountains special tax district, of which Stephens County is a part, in an amount not to exceed $1,259,664,582 and for a period of time not to exceed ten (10) years duration commencing January 1, 2013 subject to the approval of the voters of said special tax district is hereby issued.

(2) That said Special Election shall be held on July 31, 2012, between the hours of 7:00 a.m. and 7:00 p.m.; that all persons who are not registered to vote and who desire to register to vote in the special election may register to vote through the close of business on July 2, 2012.

(3) That the question to be put before the voters of Stephens County, as part of the Georgia Mountains special tax district, shall be placed on the ballot and read as follows:

NOTICE OF PUBLIC HEARING

ORDINACES

The Stephens County Board of Commissioners will hold a public hearing to consider amending Section 50 Parks and Recreation to add Article I, II, and III, and adding Section 50-3 Recreation Complex Pet ordinance, more particularly set forth below, for Stephens County, Georgia. The public hearing will be held on July 24, 2012 at 8:30 a.m. at the Stephens County Historic Courthouse in the City of Toccoa. The meeting and hearing will be held in accordance with the provisions of Chapter 1 of The Code of Stephens County, Georgia which sets forth the policies and procedures for the conduct of public hearings. All interested parties are invited to attend the public hearing. Copies of the proposed ordinances and Chapter 1 of The Code of Stephens County, Georgia which sets forth the policies and procedures for the conduct of public hearings can be obtained from the Clerk of the Stephens County Board of Commissioners at the Board of Commissioners office located in the Stephens County Historic Courthouse, 37 West Tugalo Street, Toccoa, Georgia 30577.

The proposed ordinances will be considered for adoption as applicable, on July 24, 2012 at 8:30 a.m. at the regular meeting of the Stephens County Board of Commissioners and on August 14, 2012 at 5:00 p.m. at the regular meeting of the Stephens County Board of Commissioners. The final vote for adoption shall take place on August 14, 2012 at 5:00 p.m. at the regular meeting of the Stephens County Board of Commissioners following the public hearing set forth above, unless otherwise postponed in the discretion of the Stephens County Board of Commissioners. A synopsis of the proposed ordinances to be considered for adoption by the Stephens County Board of Commissioners is as follows:

Article I. In General.

Sec. 50.1. Hours of use.

All county public parks located within the unincorporated area of the county shall be open from 6:00 a.m. until 10:00 p.m. each day. The parks, except as hereinafter set out, shall be closed for use from 10:00 p.m. until 6:00 a.m. each day; provided, however, that the hours when public parks are closed to the general public shall not apply to persons using the parks for the purpose of putting in or removing a boat, using the parks for fishing, or camping in designated camping areas within the parks.

Article II. Possession of Alcohol

Sec. 50.2. Use and possession of alcohol prohibited.

No person shall use or possess alcoholic beverages within any public park located in the unincorporated area of the county. Alcoholic beverages shall include malt beverages, wine, and distilled spirits as the same are defined in O.C.G.A. title 3.

Article III. Recreation Complex Pet Policy

Sec. 50.3. Recreation Complex Pet Policy

No pet belonging to or in the control of any person, including, but not limited to, any visitor, invitee, employee, participant or spectator in any sporting event or other event, or any other person on the premises shall be allowed in or on any portion of the Stephens County Recreation Complex located at 199 Roselane Park Drive, Toccoa, Georgia 30577 unless the pet is on a leash. This policy shall not apply to specially trained animals assisting persons with disabilities. This policy shall not apply to any County approved or sponsored event in which pets are the main purpose of the activity or event, such as a pet show or contest. Any person in violation of this policy and not subject to one of the exceptions above shall be asked to vacate the Stephens County Recreation Complex by Recreation Department Staff and upon refusal to voluntarily vacate, with the assistance of the Stephens County Marshal or the Stephens County Sheriff or Deputy Sheriff.
