NOTICE OF SALE UNDER POWER

CHATTOOGA COUNTY

Pursuant to the Power of Sale contained in a Security Deed given by Anthony E. McGuire and Gina W. McGuire to United Community Mortgage Services, Inc. dated 1/25/2005 and recorded in Deed Book 468 Page 331, Chattooga County, Georgia records; as last transferred to JPMorgan Chase Bank, National Association, successor in interest by purchase from the FDIC as Receiver of Washington Mutual Bank fka Washington Mutual Bank, FA, conveying the after-described property to secure a Note in the original principal amount of $ 210,000.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Chattooga County, Georgia, within the legal hours of sale on March 5, 2013 (being the first Tuesday of said month unless said date falls on a Federal Holiday), the following described property:

All that tract or parcel of land lying and being in Land Lot 132 in the 14th District and 4th Section of Chattooga County, Georgia and being more particularly described as follows:

To find the point of beginning. Begin at the northeast corner of land lot 132; thence south 02 degrees 29 minutes 44 seconds west 863.03 feet to a metal post; thence south 03 degrees 10 minutes 00 seconds west 44.29 feet to a 3/4 inch pipe and the point of beginning; thence south 03 degrees 10 minutes 00 seconds west 418.05 feet to a 3 inch pipe; thence north 83 degrees 04 minutes 54 seconds west 328.87 feet to a 3/4 inch pipe; thence north 03 degrees 10 minutes 00 seconds east 338.97 feet to a point; thence north 03 degrees 10 minutes 00 seconds east 39.41 feet to a 3/4 inch pipe; thence north 90 degrees 00 minutes 00 seconds east 328.66 feet to the point of beginning.

Together with a 30 foot easement leading easterly from State Route 100, the centerline of which begins 39.41 feet south of the northwest corner of captioned tract; thence south 75 degrees 56 minutes 49 seconds west 64.84 feet to a point; thence south 89 degrees 50 minutes 38 seconds west 113.81 feet to a point; thence south 88 degrees 06 minutes 41 seconds west 94.37 feet to a point; thence north 56 degrees 58 minutes 45 seconds west 33.84 feet to the right-of-way of state route 100. Said easement being 30 feet in width and 15 feet on either said of said centerline.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney s fees (notice of intent to collect attorney s fees having been given). Federal National Mortgage Association is the current owner of the loan.

Said property is commonly known as 6093 Highway 100, Summerville, Georgia 30747 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): Anthony E. McGuire and Gina W. McGuire or tenant or tenants.

JPMorgan Chase Bank, NA is the entity or individual designated, who shall have full authority to negotiate, amend and modify all terms of the mortgage pursuant to established guidelines.

Said property will be sold subject to: (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) unpaid water or sewage bills that constitute a lien against the property whether due and payable or not yet due and payable and which may not be of record, (c) the right of redemption of any taxing authority, (d) any matters which might be disclosed by an accurate survey and inspection of the property, and (e) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed. Pursuant to O.C.G.A. Section 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and non-judicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided immediately above.
