SUMMONS AND PROCESS TO: Bobbie Jessica Prather a/k/a Bobbie Jessica Prather McCain, Joshua McCain, and John Doe, and any other unknown, unnamed biological and/or legal father of the minor child J.P. born to Bobbie Jessica Prather on November 29, 2010. In accordance with O.C.G.A. 15-11-96(b) you are hereby notified that this proceeding and the hearing specified herein is for the purposes of terminating parental rights. You are hereby notified that a Petition for Termination of Parental Rights on the above-named child has been filed in the Cherokee County Juvenile Court by the Cherokee County Department of Family and Children Services. A copy of the Petition can be obtained from the Clerk of the Cherokee County Juvenile Court located at 90 North Street, Canton, Georgia 30114. This is a summons requiring you to be in Court. If you fail to come to Court as required you may be held in contempt of Court and punished accordingly. Now therefore, you, the party name above are commanded to be and appear on the date and time stated below, and to remain in attendance from hour to hour, day to day, month to month and year to year as the case may be continued, and until discharged by the Court, and you are commanded to lay all other business aside and to be and appear before the Juvenile Court of Cherokee County, Georgia located at 90 North Street, Canton, Georgia 30114 on October 18, 2012 at 8:30 a.m. You are ordered to appear and make a defense thereto and to show cause why the child should not be dealt with according to the law. Petitioner seeks to terminate your parental rights to the child. An Order terminating the parental rights of a parent terminates all of his or her rights and obligations with respect to the child and all rights and obligations of the parent arising from parental relationships, including rights of inheritance. A parent is not thereafter entitled to notice of proceedings for the adoption of the child by another nor has he or she any right to object to the adoption or otherwise to participate in the proceedings. Pursuant to O.C.G.A. § 15-11-96, notice is given to you as the putative father that is not the legal father of the child, that unless you file a Petition to Legitimate said child pursuant to O.C.G.A. § 19-7-22 within 30 days of your receipt of this notice and file notice of such filing with this Court you have no right to object to the termination of your parental rights in said child and your parental rights will be summarily terminated. The child and other parties involved may be represented by a lawyer at all stages of these proceedings. If you want a lawyer, you may choose and hire your own lawyer. If you want to hire a lawyer, please contact your lawyer immediately. If you want a lawyer but are not able to hire a lawyer without undue financial hardship, you may ask for a lawyer to be appointed to represent you. The Court would inquire into your financial circumstances and if the Court finds you to be financially unable to hire a lawyer, then a lawyer will be appointed to represent you. If you want a lawyer appointed to represent you, you must let the Court or the officer of this Court handling this case know that you want a lawyer immediately.
