CN3323 NOTICE OF SALE UNDER POWER WHEREAS, on 12/19/88, for value received, Cynthia T. Gladden executed and delivered to the United States of America, acting through the United States Department of Agriculture, a Deed to Secure Debt conveying certain real estate located in Catoosa County, Georgia, and said Deed to Secure Debt was recorded in the Office of the Clerk of the Superior Court for Catoosa County, Georgia, in Book # 366, Page# 585; and WHEREAS, on 07/19/93, for value received, Cynthia T. Gladden executed and delivered to the United States of America, acting through the United States Department of Agriculture, a Deed to Secure Debt conveying certain real estate located in Catoosa County, Georgia, and said Deed to Secure Debt was recorded in the Office of the Clerk of the Superior Court for Catoosa County, Georgia, in Book #462, Page#110; and WHEREAS, the United States of America now holds the above described security deeds covering the said real estate; and WHEREAS, the Deeds to Secure Debt held by the United States of America provides that should default occur, the holder may declare the entire indebtedness secured by the Deeds to Secure Debt due and payable and, in compliance with the power of sale provisions contained in said security deeds proceed to sell the property at public outcry; and WHEREAS, after default, the United States of America has declared all of the indebtedness secured by the Deeds to Secure Debt due and payable and hereby certifies that it has complied with all of its loan servicing regulations; NOW, THEREFORE, the said United States of America, acting as aforesaid, under and in compliance with the power of sale provision contained in the Deed to Secure Debt, will proceed to sell at public outcry, for cash or certified funds to the highest bidder in front of the Courthouse in Catoosa County, during the legal hours of sale, on the 7th day of August, 2012, the following-described property conveyed in the Deed to Secure Debt, to Wit: All that tract or parcel of land lying and being in Original Land Lot No. 186 in the 28th District and 3rd Section of Catoosa County, Georgia, being known and designated as Lot No. Forty-seven (47), HOLCOMB ROAD SUBDIVISION, Unit 4, Extension 3, as shown by plat of said subdivision in Plat Book 10, page 33, in the Office of the Clerk of the Superior Court of Catoosa County, Georgia. Being the same property conveyed by Donna N. Peterson to Robert Charles and Rebecca S. Brocksmith, in Deed Book 315, page 294, in the Office of the Clerk of the Superior Court of Catoosa County, Georgia. SUBJECT TO Restrictions of record in Deed Book 185, page 444, in the Office of the Clerk of the Superior Court of Catoosa County, Georgia. Pursuant to 44-14-162.2, 44-14-162.3 and 44-14-162.4, Official Code of Georgia, the borrower was provided notice of said sale no later than l5 days before the date of sale by mailing a copy of the Notice of Sale to the borrower. TO HAVE AND TO HOLD the said bargained premises, together with all and singular the rights and appurtenances thereof to the same being or in anywise appertaining, to the use, benefit, and behoof of the said part____ of the second part in fee simple.
