CN3328 NOTICE OF SALE UNDER POWER, CATOOSA COUNTY Pursuant to the Power of Sale contained in a Security Deed given by Khamphaeng Yunyong to Mortgage Electronic Registration Systems, Inc., as nominee for Capital One Home Loans, LLC dated 12/12/2005 and recorded in Deed Book 1247 Page 671, CATOOSA County, Georgia records; as last transferred to THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF CWABS, INC., ASSET-BACKED CERTIFICATES, SERIES 2006-3 by Assignment filed for record in CATOOSA County, Georgia records, conveying the after-described property to secure a Note in the original principal amount of $ 115,200.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of CATOOSA County, Georgia, within the legal hours of sale on the first Tuesday in August, 2012 (August 07, 2012), the following described property: The following described real property situate in the City of Fort Oglethorpe, County of Catoosa, and State of Georgia, to wit: The following property: All that tract or parcel of land lying and being in original Land Lot No. 95, in the 9th District and 4th Section of Catoosa County, Georgia being Lot Five (5) of Fort Woods Subdivision, as shown by plat recorded in Plat Book 8, Page 81, in the Office of the Clerk of the Superior Court of Catoosa County, Georgia. The Source Deed as stated above is the last record of vesting filed for this property. There have been no vesting changes since the date of the above referenced source. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed.
