FINDING OF NO SIGNIFICANT IMPACT



The Georgia Department of Community Affairs (DCA) received an application on June 14, 2012 for the award of federal HOME funding for the development of this project. A preliminary award was granted on December 7, 2012. DCA has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.



Additional project information is contained in the Environmental Review Record (ERR) prepared by DCA. This ERR is on file at DCA at 60 Executive Park South, N.E. Atlanta, GA 30329 by appointment only and may be examined or copied weekdays from 8:30 A.M. to 5:00 P.M.



PUBLIC COMMENTS



Any individual, group, or agency wishing to comment on the project or ERR may submit written comments to Fenice Taylor, from February 1, 2013 through February 18, 2012. All comments must be received by within the fifteen (15) day comment period.



RELEASE OF FUNDS



DCA certifies to the HUD that Fenice Taylor in her capacity as Acting Chief Executive Officer consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The HUD approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows DCA to use Program funds.



OBJECTIONS TO RELEASE OF FUNDS



Following its receipt of DCA s request for release of funds, HUD will accept objections to the release of funds or DCA certification for a period of fifteen days only if the objections are made on one of the following bases:



(a) The certification was not executed by the Certifying Officer of DCA;

(b) DCA has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58;

(c) The grant recipient or other participants in the development process has committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the HUD; or

(d) Another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.

Conduct giving rise to said seizure was as follows: On December 19, 2012, a Hogansville Police Department officer observed a 1999 Mazda 626 with a tag light violation traveling south on I-85 near mile marker 28, in Troup County. The officer initiated a traffic stop on the vehicle for tag light violation. The officer smelled a strong odor of marijuana emanating from inside the vehicle while speaking with driver. A check through GCIC revealed defendant s driver s license suspended. Consent to search was given and 10.5 pounds of marijuana was discovered inside the trunk area of the vehicle. Defendant was arrested for V.G.C.S.A. Trafficking in Marijuana and Driving while License Suspended.

Said property was found on the above date to be in close proximity to a quantity of marijuana, a controlled substance, and was used or intended to be used to facilitate a violation of the Georgia Controlled Substance Act (16-13-30), or represents proceeds derived or realized through a violation of the Georgia Controlled Substances Act (16-13-30).

Conduct giving rise to said seizure was as follows: On November 25, 2012, a Hogansville Police Department officer observed a 2005 Ford F-150 with dark tinted windows traveling south on I-85 near mile marker 28, in Troup County. The officer initiated a traffic stop on the vehicle for window tint violation, failure to maintain lane and following too closely. The driver of the vehicle was Demetric Cox, and the passenger of the vehicle was Christopher S. Turner. The officer detected an odor of marijuana emanating from inside the truck. A search of the vehicle was conducted, and two pounds of marijuana and cocaine residue were discovered. After defendants were transported to the Troup County Jail, 40 grams of cocaine were discovered in the back seat of the patrol car. Defendants were arrested for V.G.C.S.A. Trafficking in Cocaine, Possession of Marijuana with Intent to Distribute, Failure to Maintain Lane and Following too Closely.

Said property was found on the above date to be in close proximity to a quantity of marijuana and cocaine, controlled substances, and was used or intended to be used to facilitate a violation of the Georgia Controlled Substance Act (16-13-30), or represents proceeds derived or realized through a violation of the Georgia Controlled Substances Act (16-13-30).

The property seized is: One Thousand, Fifty-Three Dollars in United States Currency.

Conduct giving rise to said seizure was as follows: On December 8, 2012, LaGrange Police Department officers responded to 1603 Vernon Road, a business, based on reports of gambling at said location. At the back of the business, officers observed a mini casino set up, complete with a poker table and several slot machines. They also witnessed several people involved in a poker game. When Robert Alexander Hill, the owner of the business, arrived, he tried to leave as soon as he noticed the police. Mr. Hill was then detained and interviewed. Mr. Hill admitted that he was running a poker game where people would pay him to get into the game, and the winner of the game would win the cash that had been paid into the game. He stated that the business was set up as a thrift store, but there was limited merchandise that could be sold. Mr. Hill was subsequently arrested for Gambling and then Possession of a Schedule IV Substance when he was found with adipex without a valid prescription. The majority of the currency that was seized was found on Mr. Hill, which he attempted to conceal from officers. The remainder of the currency seized came from the cash register of the business.

Said property represents proceeds from gambling (O.C.G.A. 16-12-30), or represents property derived from a violation of Title 16, Chapter 12, Article 2, of the official code of Georgia (O.C.G.A. 16-12-32).
