Pursuant to the Power of Sale contained in a Security Deed given by Damion Lee Moore to Mortgage Electronic Registration Systems, Inc. as nominee for United Community Mortgage Service, Inc. dated 3/26/2010 and recorded in Deed Book 572 Page 705, Chattooga County, Georgia records; as last transferred to JPMorgan Chase Bank, National Association, conveying the after-described property to secure a Note in the original principal amount of $ 55,700.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Chattooga County, Georgia, within the legal hours of sale on March 05, 2013 (being the first Tuesday of said month unless said date falls on a Federal Holiday), the following described property:

All that tract or parcel of land situated, lying, and being in Land Lot 108 in the 14th District and 4th Section of Chattooga County, Georgia, and being more particularly described as follows:

To find the true point of beginning commence at the intersection of the center of the Central of Georgia Railway Tract with the northeast right of way of Hammond Street in the Town of Lyerly and thence running north 58 42' 19" west 250 feet across the northeast right of way of Hammond Street to an iron pin which is the point of beginning; thence north 58 42' 19" west 45 feet to an iron pin; thence north 42 00' 00" east 198 feet to an iron pin; thence south 58 28' 00" east 46 feet to an iron pin; thence south 42 17' 40" west 198 feet to the point of beginning. Being improved property with a residence erected thereon. Said tract containing 0.21 acres.

Being the same property as in Warranty Deed to Dempsey Lawson from The Secretary of Housing and Urban Development of Washington, D.C., recorded September 24, 2009 in Deed Book 566, Page 345 in the Office of the Clerk of Superior Court, Chattooga County, Georgia; and also by Warranty Deed to The Secretary of Housing and Urban Development of Washington, D.C. from Taylor, Bean & Whitaker Mortgage Corporation recorded on February 24, 2009 in Deed Book 557, Page 744 Chattooga County Deed Records.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney s fees (notice of intent to collect attorney s fees having been given).

Said property is commonly known as 255 Hammond Street, Lyerly, GA 30730 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): Damion Lee Moore or tenant or tenants.

JPMorgan Chase Bank, NA is the entity or individual designated who shall have full authority to negotiate, amend and modify all terms of the mortgage pursuant to established guidelines.

Section 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and non-judicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided immediately above.
