Riddle to Wells Fargo Bank, N.A. dated 11/23/2004 and recorded in Deed Book 767 Page 38, HARALSON County, Georgia records; as last transferred to Deutsche Bank National Trust Company, as Trustee for ABFC 2005-WF1 Trust, ABFC Asset Backed Certificates, Series 2005-WF1 by Assignment filed for record in HARALSON County, Georgia records, conveying the after-described property to secure a Note in the original principal amount of $ 96,000.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of HARALSON County, Georgia, within the legal hours of sale on the first Tuesday in September, 2012 (September 4, 2012), the following described property: All that tract or parcel of land lying and being in Land Lots 225 and 226 of the 7th District and 5th Section of Haralson County, Georgia, and being a composite tract of land carved from a larger tract acquired by Jessie Robinson by deeds in Book 92, Page 382, and Deed Book 70, Page 402, Haralson County Deed Records. Said composite tract of land is shown on a plat in Plat Book 1-B, Page 20, in the Office of the clerk of Superior Court of Haralson County, Georgia, which plat and the record thereof are by reference incorporated herein. The within tract of land being designated on said plat as "Property of Rilla M. Robinson and Property of J. R. Robinson". Said tract of land is more particularly described as BEGINNING at the intersection of the west land lot line of Land Lot 226 where it intersects the northeasterly side of Old Bremen-Carrollton Road, sometimes referred to as Sangamore Road, and from said Point of Beginning, running southeasterly along the right of way of said road 210 feet to corner; thence north 305 feet to an iron pin at property of Jessie Robinson; thence along Robinson property south 72 degrees west 120 feet to the west line of Land Lot 225, which is the east line of Land Lot 226; thence into Land Lot 226, south 59 degrees 40 minutes west 42.7 feet to the northeast side of Sangamore Road; thence southeasterly along said road to the east line of original Land Lot 226 and the Point of Beginning. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney s fees (notice of intent to collect attorney s fees having been given). Said property is commonly known as 1188 South Georgia Avenue, Bremen, Georgia 30110 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): William D. Riddle or tenant or tenants. Said property will be sold subject to: (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) the right of redemption of any taxing authority, (c) any matters which might be disclosed by an accurate survey and inspection of the property, and (d) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
