By Security Deed dated September 15, 2011, recorded in Deed Book 41, at pages 304-308, in the Office of the Clerk of the Superior Court, Chattahoochee County, Georgia, Panzer Properties, LLC (MORTGAGOR) conveyed to Jeffrey L. McCrary and Michelle McCrary to secure its Note of the same date for $400,000.00, the following described real estate: All that tract and parcel of land situate, lying and being in Land Lot 49 of the 6th District of Chattahoochee County, Georgia being shown as 17.80 acres on a survey of Part of Land Lot 49, 6th District, Cusseta, Chattahoochee County, Georgia , dated September 8, 1998 prepared by Hobbs, Smith & Assoc., Inc. and recorded in Plat Book 4, at Page 90 in the office of the Clerk of the Superior Court of Chattahoochee County, Georgia, the property conveyed hereby being more particularly described as follows: to arrive at the point of beginning commence at the southwestern most point of the line segment formed by the intersection of the Northeast right of way line of Georgia Highway 520 (Business) and the South right of way line of Georgia Highway 26, and running thence in a southeasterly direction along the northeast right of way line of Georgia Highway 520 a distance of 867.86 feet to an iron pint which marks the point of beginning of the property conveyed hereby; and from said point of beginning running North 73 degrees 17 minutes East a distance of 150.0 feet to an iron; thence running North 28 degrees 02 minutes 30 seconds West a distance of 100.0 feet to an iron; thence running North 74 degrees 52 minutes West a distance of 29.0 feet to an iron; thence running North 18 degrees 31 minutes 30 seconds West a distance of 192.83 feet to an iron; thence running North 86 degrees 00 minutes East a distance of 1140.89 feet to an iron; thence running South 01 degree 18 minutes 30 seconds West a distance of 615.13 feet to an iron on the northwest line of Principles Drive; running thence South 74 degrees 13 minutes 49 seconds West along the northwest line of Principles Drive a distance of 947.40 feet to an iron at the intersection of the northwest line of Principles Drive and the northwest line of Principles Drive and the northeast right of way line of Georgia Highway 520; thence running North 29 degrees 34 minutes West along the northeast right of way line of Georgia Highway 520 a distance of 196.0 feet to an iron; running thence North 30 degrees 46 minutes 30 seconds West along the northeast right of way line of Georgia Highway 520 a distance of 349.83 feet to the point of beginning. Together with all mobile homes located thereon.

WHEREAS, said Mortgagor has defaulted in the performance of its obligations and covenants required under said Note and Security Deed; i.e., Mortgagor has failed to make the payments required under said documents and Mortgagor has filed to pay the real estate ad valorem taxes due for said property; and Jeffrey L. McCrary and Michelle McCrary, the present holders and owners of said Note and Security Deed, have declared the entire debt secured by said Security Deed due and payable;

THEREFORE, pursuant to the terms of said Security Deed and the law in such cases made and provided, the undersigned will sell the above described property, at public outcry, to the highest bidder for cash, on the first Tuesday in December, 2012, within the legal hours of sale, at the usual place of holding sales before the Courthouse door in Chattahoochee County, Georgia. Said property will be sold subject to unpaid Ad Valorem taxes due thereon, all valid restrictive covenants and easements of record applicable thereto.

The proceeds from said sale will be applied as provided in said Security Deed and a deed conveying said real estate will be made to the purchaser, subject to the taxes, restrictions and easements hereinabove mentioned.

Jeffrey L. McCrary and Michelle McCrary acting under and by virtue of the powers contained in said security instrument and as attorney in fact for Panzer Properties, LLC.
