GEORGIA, TERRELL COUNTY
Under and by virtue of the power of sale contained in that certain Deed to Secure Debt, dated December 21, 2006, from Robert Perry to Bank of Dawson, and filed for record on December 28, 2006, and recorded in Deed Book 8-J, Page 125-128, in the Office of the Clerk of the Superior Court of Terrell, Georgia, the undersigned will sell at public outcry during the legal hours of sale before the Courthouse in Terrell County, Georgia, on the first Tuesday in December, 2012, to the highest bidder for cash, the following described real property, to-wit:
All that tract or parcel of land situate, lying and being in Land Lot 232 of the 11th Land District of Terrell County, Georgia, and being more particularly described as follows: To find the Point of Beginning commence at the point of intersection of the center line of Veney's Mill Road with the west land lot line of Land Lot 232; from said point, thence go along the curve of the center line of Veney's Mill Road the arc of which is 250.66 feet and the chord bearing being south 87 degrees 36 minutes 06 seconds east a distance of 250.16 feet to a point on the center line; thence continue south 82 degrees 04 minutes 56 seconds east a distance of 626.07 feet to a point; thence go north 07 degrees 55 minutes 04 seconds east a distance of 40 feet to the north right-of-way of Veney's Mill Road and the Point of Beginning of the herein described property; from said point of beginning thence go north 04 degrees 34 minutes 26 seconds east a distance of 180 feet to an iron pin; thence go south 82 degrees 04 minutes 56 seconds east a distance of 125 feet; thence go south 04 degrees 34 minutes 26 seconds east a distance 180 feet to the north right-of-way of Veney's Mill Road; thence go north 82 degrees 04 minutes 56 seconds west a distance of 125 feet along the north right-of-way of Veney's Mill Road to the Point of Beginning. Said tract containing one-half (.50) of an acre.
The debt secured by said Deed to Secure Debt is evidenced by one note from Robert Perry in favor of Bank of Dawson, dated December 21, 2006 in the principal amount of Sixty-Two Thousand Eight Hundred Ten & 51/100 ($62,810.51) Dollars.
The debt secured by said Deed to Secure Debt and evidenced by said note has been and is hereby declared due and payable because of Grantor's failure to pay said note as the same became due. The debt remaining in default, this sale will be made for the purpose of paying said indebtedness including all accrued and unpaid interest thereon and attorney's fees and all expenses of said sale.
Pursuant to O.C.G.A. 44-14-162.2, the person who shall have full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is as follows: BANK OF DAWSON, P.O. Box 230, Dawson, GA 39842. Provided however, such person shall not be required to negotiate, amend or modify the terms of a mortgage instrument.
This property will be sold as the property of Robert L. Perry, who, to the best of the undersigned's knowledge and belief is the party in possession of said property.
Notice has been given of intention to enforce provisions for collection of attorney's fees and foreclosure in accordance with legal requirements and the terms of said Deed to Secure Debt and note.
Said property will be sold subject to any and all unpaid taxes and assessments, if any, and other restrictions and easements of record, if any.
