NOTICE OF SALE UNDER POWER
Because of default in the payment of notes secured by a deed to secure debt executed by James Wade Madray, dated October 13, 2000, recorded in Deed Book 22-F, Pages 131-137, Wayne County records, the undersigned has declared the full unpaid amount of the indebtedness referred to due and payable and, acting under the power of sale contained in said deed, for the purpose of paying said indebtedness, will on the first Tuesday in December, 2012, during the legal hours of sale at the Wayne County Courthouse, sell at public outcry to the highest bidder for cash, the lands described in said deed, to-wit:
All that certain tract or parcel of land situate, lying and being in Land Lot Number 143 of the Third Land District of Wayne County, Georgia, containing 96.37 acres, more or less, and being more particularly described as that portion of "Tract 2a" as shown on a plat prepared by Quillie E. Kinard, Jr., R.L.S. Number 1572, dated December 28, 1995, revised on June 23, 2000 and recorded in the Office of the Clerk of Superior Court, Wayne County, Georgia in Plat Book 39, Page 17. For further description of said property, reference is hereby made to the aforesaid plat and the record thereof. This being the portion of the same property conveyed to Carolyn W. Wynn by deed dated December 29, 1995 and recorded in the Office of the Clerk of Superior Court,Wayne County, Georgia in Deed Book 344, Page 305.
"BORROWER RECOGNIZES THAT THE LOAN DESCRIBED IN THIS NOTE WILL BE IN DEFAULT SHOULD ANY LOAN PROCEEDS BE USED FOR A PURPOSE THAT WILL CONTRIBUTE TO EXCESSIVE EROSION OF HIGHLY ERODIBLE LAND OR TO THE CONVERSION OF WETLAND TO PRODUCE OR TO MAKE POSSIBLE THE PRODUCTION OF ANY AGRICULTURAL COMMODITY, SUBJECT 7 CFR PART 1940, SUBPART G, EXHIBIT."
Said property is to be sold subject to any outstanding ad valorem taxes (including taxes, which are liens, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens and encumbrances, zoning ordinances, restrictions, covenants and matters superior to the aforesaid Deed to Secure Debt first set out above. The undersigned will execute a deed to the purchaser as authorized by the aforementioned debt deed. This the 2nd day of November, 2012.
