By virtue of Power of Sale contained in Deed to Secure Debt from John H. Wallace to E. Dean Rosier and Charles M. Jones III, d/b/a Delta Partners, Dated 7/28/1999 and executed on 8/6/1999 said deed being given to secure a note Dated 7/28/1999 in the original principal amount of $19400.00, and recorded in Deed Book 5-R, Page 649, Clerks office Terrell County, Georgia with interest from date at the rate provided in the note on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Terrell County, Georgia, within the legal hours of sale on the first Tuesday in December, 2012 the following described property:
All that tract or parcel of land lying and being in Land Lot(s) 254 & 255, in the 4th Land District, Terrell County, Georgia, and being all of Lot 002 of Bellflower Estates Subdivision, according to a map or plat of said subdivision as same is recorded in Plat Book 5, Page 362, in the Office of the Clerk of Superior Court, Terrell County, Georgia.
The debt secured by said Security Deed has been and is hereby declared due because of non-payment on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
Said property will be sold as the property of John H. Wallace. The property, to the best information, knowledge and belief of the undersigned, being presently in the possession of John Wallace. Said property will be sold subject to any outstanding ad valorem taxes and/or assessments, if any and subject to any prior matters of record, if any.
