NOTICE OF SEIZURE AND FORFEITURE OF PERSONAL PROPERTY\

VALUED AT LESS THAN $25,000\

Pursuant to OCGA 16-13-49, you are hereby notified that on the 28th day of June, 2012, the following property was seized from Michael Formey by the undersigned agency and there is a forfeiture pending against said property in Ware County, Georgia:\

One (1) 1993 Chevrolet Caprice Classic, white in color, VIN-1G1BL53E4PR107538, GA tag #BNY3146.\

The conduct giving rise to said seizure was as follows:\

On June 28th, 2012, Deputy Steven Wright and Deputy Clinton Banks of the Ware County Sheriff\'92s Office were on patrol on State Street in Ware County, Georgia. \'a0The officers observed a white Chevrolet Caprice sitting at the intersection of Clough Street and State Street for an extended period of time of 30-45 seconds with no other vehicles around them that would prevent the vehicle from moving past the intersection. \'a0When the vehicle pulled onto State Street, Deputy Wright conducted a traffic stop. \'a0The driver, Michael Formey appeared to be nervous while producing his driver\'92s license to Deputy Wright. \'a0Michael Formey advised the officers that he and his passenger, Octavious Morris were from Jesup, Georgia, and had been at a club in Waycross. \'a0Formey gave Deputy Wright his consent to search his vehicle. \'a0The deputies located in the glove compartment a clear bag which had 7 small bags of marijuana inside it. \'a0A clear bag containing 13 small bags of marijuana were located under the driver\'92s seat. \'a0A cigarillos case was located in the backseat containing 3 Hydrocodone pills and 3 Alprazolam pills. \'a0The vehicle was seized and towed to the Ware County Sheriff\'92s Office. \'a0Michael Formey and Octavious Morris were charged with Possession of Marijuana with Intent to Distribute and Possession of a Schedule III and Schedule IV Drugs. Said property was used or intended for use to facilitate a violation of O.C.G.A. \'a716-13-30, or proceeds derived or realized therefrom.\

You may file a claim by sending the claim by certified mail, return receipt requested, to the District Attorney and to the seizing agency at the addresses shown below. \'a0Your claim must comply with the requirements set forth in OCGA 16-13-49(n)(4) and must be filed within thirty (30) days of the second publication of this notice in the official organ of Ware County, Georgia.\
