NOTICE FOR SERVICE BY PUBLICATION

TO: The Persons Listed as Respondents in the above captioned matter, and to any additional person claiming to be an heir at law of the late Fleet Wood F. W. Cooper.

Please take notice that on September 27th, 2012 Lou Heath, Tax Commissioner of Webster County, Georgia commended an action in the Superior Court of Webster County, pursuant to O.C.G.A. 48-4-5, to interplead a sum of money into the registry of the Court composing excess funds from a tax sale of real property previously belonging to the late F.W. Cooper, and to request that the Court authorize and direct the Clerk of Court as to the manner in which such excess proceeds shall be distributed to the heirs at law of F. W. Cooper, after deduction of costs and reasonable attorneys fees incurred in connection with this civil action.

By order of the Superior Court of Webster County, Georgia dated October 9th, 2012, the Superior Court of Webster County, Georgia has entered an order for service by publication, in additional to personal service upon the Respondents.

The above named Respondents and any additional person claiming to be an heir at law of the late F. W. Cooper, and any such person claiming to have an interest in the excess funds deposited and held in the registry of the Court is hereby commanded to file with the Clerk of Superior Court of Webster County, Georgia, and to serve upon the Attorney for the Petitioner, C. Frederick Overby, Overby Law Office, P.C., Post Office Box 1975, Columbus, Georgia 31902, an Answer to said petition within sixty (60) days of the date of the order directing service of publication as set forth above.
