You are hereby notified that the above styled action seeking an Order and Judgment to declare the foreclosure sale held on December 4, 2007, invalid; that the Court declare the Deed Under Power recorded at Deed Book 46212, Page 412, in the Fulton County deed records, and any other deed executed and recorded pursuant to the foreclosure sale, null, void and of no legal effect; that the Court declare that the Security Deed recorded at Deed Book 37235, Page 165, in the Fulton County deed records is reinstated, that the Security Deed remains a lien against the Property, and that the parties thereto have the same rights and remedies as though the foreclosure sale never occurred; that the Court declare that the 2nd Security Deed recorded at Deed Book 37235, Page 174, in the Fulton County deed records is reinstated, that the 2nd Security Deed remains a lien against the Property, and that the parties thereto have the same rights and remedies as though the foreclosure sale never occurred; that the Court order that any order entered by it be filed in the Fulton County property deed records and cross-referenced with the following:
--The Warranty Deed recorded at Book 37235, Page 163;
--The Security Deed recorded at Book 37235, Page 165;
--The 2nd Security Deed recorded at Book 37235, Page 174; and
--The Deed Under Power recorded at Book 46212, Page 412; and
that the Court grant Plaintiff such other and further relief as it deems just and proper
You are hereby commanded and required to file with the Clerk of said Court and serve upon Summer J. Hughes, Plaintiff's attorney, Johnson & Freedman, L.L.C., whose address is 1587 Northeast Expressway, Atlanta, Georgia 30329, an Answer to the Complaint within sixty (60) days of the date of the Order for Service by Publication, granted on July 13, 2012 WITNESS the Honorable Kelly A. Lee, Judge of the Superior Court of Fulton County, Georgia.
