Pursuant to Order of the Superior Court of Banks County, Georgia, dated May 22, 2012, as referenced by Civil Action Number shown below, will be sold at public out-cry to the highest bidder for cash on the first Tuesday in August, the same being August 7, 2012, during the legal hours of sale before the Banks County Courthouse door in Homer, Georgia, to satisfy delinquent taxes due the State of Georgia and Banks County, the following described property, to wit:

All that certain tract or parcel of land lying and being in the 208th G.M.D. District of Banks County, Georgia, as described in a Plat of Survey by Michael L. Scupin, Registered Surveyor, dated December 5, 1977, and prepared for Jere Kimbrell and J.H. Tow, Jr., as recorded in Plat Book 7, Page 77, Clerk Office, Banks County, Georgia.

This property being the same property described as 14.54 acres, more or less, in that certain Warranty Deed from James Morris and Stanley Lawson to Jim Smith and Patty Smith, dated May 18, 1979, and recorded in Deed Book 18, Page 413, Banks County, Georgia, Records.

Together with all rights, title, and interest running with the above-described property but not taxed under a separate tax reference number as delineated on the tax maps of the petitioner for the year(s) for the taxes being foreclosed.

The scheduled sale of said property is a judicial in rem tax foreclosure in accordance with the provisions of O.C.G.A. 48-4-75 et seq.
