NOTICE OF SALE UNDER POWER
Under and by virtue of the power of sale contained in that certain deed to secure debt from Hubert C. Watford and Sarah D. Watford, to State Bank of Cochran, Grantee, dated October 23, 2009, and recorded in Deed Book 357, Page 242-244, Bleckley County Deed Records, said deed to secure debt having been given to secure a promissory note of even date together with all other debts, extensions, renewals and future advances thereto, there will be sold by the undersigned at public outcry to the highest and best bidder for cash, before the courthouse door in Bleckley County, Georgia, within the legal hours of sale, on the first Tuesday in August, 2012 the following described property, to-wit:
That tract of land containing 7 acres, more or less, with block building located thereon in Land Lot 110 of the 21st Land District of Bleckley County, Georgia, as shown by a plat of survey made by John W. Dye, Registered surveyor, dated February 10, 1976; recorded in Plat Book 4, Page 352 in the Office of the Clerk of Bleckley Superior Court at Cochran, Georgia, particularly described as follows: BEGIN at the point of intersection of the southeasterly line of a county unpaved road shown on said plat with the northeasterly right of way line of U.S. Highway 23 (Georgia Highway 87) and run north 46 degrees 19 minutes east 585 feet along the southeasterly line of said county unpaved road to a point marked by an iron pin; thence run south 45 degrees east 521.8 feet to a corner point marked by an iron pin; thence run south 46 degrees 20 minutes west 605.4 feet to a point marked by an iron pin on the southwest lot line of Land Lot 110; thence run north 43 degrees 04 minutes west 91.9 feet along said southwest land lot line to a point; thence 'run north 39 degrees west 108.1 feet to a point; thence run, north 42 degree 44 minutes west 151.8 feet to a point; and thence run north 45 degrees west 170 feet to the point of beginning. Said last three courses and distances being along the northeast right of way line of U,S. Highway 23 (Georgia Highway 87) as said highways existed as of February 10, 1976. The foregoing described property is the same as that conveyed to Lumber Transport Inc. from J. Leland Belflower by Warranty Deed dated July 19, 1976, recorded in Deed Book D-55; Page 72, Bleckley County Records, LESS AND EXCEPT that certain road right of way tract of land conveyed from Lumber Transport, Inc, to the Department of Transportation of the State of Georgia by Right of Way Deed dated December 7, 1982 recorded in Deed Book D-73, Page 64; Bleckley County Records and that certain road right of way tract of land conveyed from LTI Enterprises, Inc, to the Department of Transportation of the State Of Georgia by Right of Way Deed dated March 8, 1988, recorded in Deed Book D-88, page 1, Bleckley County Records.
The debt secured by said deed to secure debt and note has been and is hereby declared due and payable in full because of default pursuant to the terms of said deed to secure debt and note. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the deed to secure debt, accrued interest, all expenses of the sale, and other sums secured by the deed to secure debt, including attorney s fees, and the remainder, if any, shall be applied as required by law.
Said property shall be sold as the property of Hubert C. Watford and Sarah D. Watford subject to any and all outstanding mortgages, ad valorem taxes, street improvements, easements, or other restrictions of record, if any. The undersigned will execute a deed under power of sale to the purchaser as provided in the deed to secure debt.
