NOTICE OF SEIZURE TO INTERESTED PARTIES

The State of Georgia by and through the District Attorney for the Coweta Judicial Circuit and pursuant to O.C.G.A. Section 16-13-49, hereby gives notice that on the 7th day of December, 2012, the following property was seized by the LaGrange Police Department, and there is a forfeiture pending against said property in Troup County, Georgia.

The property seized is: One Thousand, Three Hundred and Twenty-Three Dollars ($1,323.00) in United States Currency; and one 1999 Ford F250, VIN# 1FTNX20LXXEB90376.

Conduct giving rise to said seizure was as follows: LaGrange Police Department officers conducted a traffic stop on a White 1999 Ford F250 for window tint violation. Consent to search the vehicle was given and approximately 4.7 grams of methamphetamine, digital scales, a hydrocodone pill and two glass smoking devices with suspected methamphetamine residue were discovered. Defendant was arrested for Possession of Methamphetamine with Intent to Distribute and Possession of Methamphetamine.

Said property was found on the above date to be in close proximity to methamphetamine, a controlled substance, and was used or intended to be used to facilitate a violation of the Georgia Controlled Substance Act (16-13-30), or represents proceeds derived or realized through a violation of the Georgia Controlled Substances Act (16-13-30).

You are further notified that you may file a claim within thirty (30) days of the second publication of this notice of seizure by sending a claim to the seizing law enforcement agency and to the District Attorney by certified mail, return receipt requested.

The State of Georgia by and through the District Attorney for the Coweta Judicial Circuit and pursuant to O.C.G.A. Section 16-13-49, hereby gives notice that on the 2nd day of November, 2012, the following property was seized by the West Point Police Department, and there is a forfeiture pending against said property in Troup County, Georgia.

The property seized is: One 2002 Dodge Neon Car, VIN# 1B3ES26C12D648795; and one 1989 Dodge Dakota Pickup Truck, VIN# 1B7GL26X8KS037973.

Conduct giving rise to said seizure was as follows: On November 2, 2012, dispatch advised West Point Police officers of a suspicious white Dodge Dakota Pickup Truck that kept returning to 810 Avenue I, West Point, Georgia, after the residence repeatedly requested the two subjects to leave the location. The white Dodge Dakota Pickup Truck was located after further searching the area east on 6th Street toward MLK Drive and approaching Crestview. The officer accelerated speed to catch up to the Dodge Dakota Pickup Truck and in turn the driver accelerated his speed as well. The driver turned left onto the driveway at 1007 E. 6th Street and exited the vehicle running with a white grocery type bag in his possession. The officer radioed for a wrecker to pick up the vehicle and was listening to radio traffic when he heard that the subject was located in a white Dodge Neon vehicle heading east on 6th Street. The driver of the white Dodge Neon vehicle was spotted throwing what appeared to be a large amount of marijuana out of the vehicle. The driver and passenger fled on foot. The green leafy substance that was thrown from the white Dodge Neon vehicle was located shortly after, was tested and determined to be marijuana. The amount recovered was determined to be approximately three pounds. Defendant was later identified and open warrants are pending for his arrest for Trafficking in Marijuana, Reckless Driving, Fleeing or Attempting to Elude Police Officer and Obstruction / Hindering a Law Enforcement Officer.

Said property was found on the above date to be in close proximity to marijuana, a controlled substance, and was used or intended to be used to facilitate a violation of the Georgia Controlled Substance Act (16-13-30), or represents proceeds derived or realized through a violation of the Georgia Controlled Substances Act (16-13-30).

Further, defendant Martin Bautista-Liborio had Eight Hundred Dollars in United States Currency on his person. Defendants were arrested for Trafficking in Methamphetamine and Vehicle with False / Secret Compartments.

The deputy followed defendant as he neared Exit 14 and took a sudden turn heading North on Hamilton Road and stopped at the Summit gas station at 1908 Hamilton Road in LaGrange, Georgia. The deputy exited the vehicle to speak with defendant and immediately upon contact detected a strong odor of marijuana. Consent to search the vehicle was denied by defendant and vehicle was searched due to probable cause by deputy. Twelve packages of vacuum sealed marijuana were discovered under some clothing in a green in color suitcase inside the trunk of the vehicle. Defendant was arrested for V.G.C.S.A. Trafficking in Marijuana.

The search warrant was based on information received through a separate investigation with Troup County Drug Agents that lead investigators to believe that drugs were being sold and stored at 1402 Juniper Street. Marijuana was discovered in the children s bedroom on the dresser and in the refrigerator located in the kitchen. The aforementioned seized property was found within close proximity of the marijuana. Defendant was arrested for Possession of Marijuana with Intent to Distribute and two counts of Reckless Conduct.

Said property was found on the above date to be in close proximity to marijuana, a controlled substance, and was used or intended to be used to facilitate a violation of the Georgia Controlled Substance Act (16-13-30), or represents proceeds derived or realized through a violation of the Georgia Controlled Substances Act (16-13-30).
