NOTICE OF SALE UNDER POWER
GEORGIA, TROUP COUNTY Under and by virtue of the Power of Sale contained in a Security Deed given by Bret T. Coleman to Charter Bank re- corded in Deed Book 1080, Page 524 et. seq. Troup County, Georgia Records, said Security Deed being to secure a Promissory Note in the ori- ginal principal amount of Two Hundred Thousand Dollars and 00/100 s ($200,000.00) there will be sold at public out- cry to the highest bidder for cash before the Courthouse door of Troup County, Georgia within the legal hours of sale on the first Tuesday in September, 2012 the following described property:
Begin at a concrete monu- ment located at the intersec- tion of the South margin of West 8th Street (formerly Montgomery Street) and the West margin of Fourth Avenue (formerly Jackson Street), City of West Point, Troup County, Georgia; thence South 14 de- grees 00 minutes West along the West margin of said Fourth Avenue for 170.00 feet to a concrete monument for a corner and starting point of the parcel herein described; thence 90 degrees 09 minutes to the right for 254.85 feet to an iron pin located on the Alabama-Georgia State Line for a corner; thence 115 de- grees 50 minutes to the left and along the said State Line for a distance of 91.4 feet to an iron pin for a corner; thence 64 degrees 10 minutes to the left for 215.3 feet to an iron pin for a corner located on the West margin of Fourth Avenue; thence 90 degrees 09 minutes to the left with a bearing of North 14 degrees 00 minutes East along the West margin of said Fourth Avenue for 82.0 feet to a concrete monument for a corner and the starting point.
The above described property is the same property de- scribed in a certain deed recor- ded in Deed Book 68, Page 322, in the Office of the Clerk of the Superior Court of Troup County, Georgia, and is a part of Block Number 9 in the City of West Point, Georgia.
This being the same property conveyed to Bret T. Coleman by that certain deed from Ben Coleman, Jr. recorded in Deed Book 828, Page 354, in the Troup County, Georgia, re- cords.
The debt secured by said Se- curity Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Se- curity Deed. The debt remain- ing in default, this sale will be made for the purpose of pay- ing the same and all expenses of this sale, as provided in Se- curity Deed and by law, includ- ing attorney s fees (notice of intent to collect attorney s fees having been given). Said prop- erty will also be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an ac- curate survey and inspection of the property, any assess- ments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of re- cord superior to the Security Deed first set out above.
To the best knowledge and be- lief of the undersigned, the party in possession of the property is Bret T. Coleman or tenant or tenants. The individu- al who shall have full authority to negotiate, amend and modi- fy all terms of the mortgage with the debtor is Michael T. Trimeloni, Charter Bank, 1233 OG Skinner Drive, West Point, GA 31833 706-645-3267. Nothing in O.C.G.A. 44-14- 162.2 shall be construed to re- quire this lender to negotiate, amend or modify the terms of the mortgage.
