Notice Of Sale Under Power In Security Deed
Under and by virtue of Power of Sale contained in Security Deed from EDDIE MC- CARDEN to MCINTOSH COMMERCIAL BANK, dated September 7, 2007, recorded in Deed Book 1438, page 64, Troup County Records, which has been assigned to Charter- Bank by Assignment of Loan and Liens, dated September 9, 2010, recorded in Deed Book 1593, page 32, said County Records, there will be sold by the undersigned at public out- cry to the highest bidder for cash before the Courthouse door at Troup County, Georgia, within the legal hours of sale on the first Tuesday in September, 2012, the follow- ing described property:
THE LEGAL DESCRIPTION IS SHOWN ON THE ATTACHED SHEET, MARKED EXHIBIT A , AND MADE A PART HEREOF BY REFERENCE. Said property has an address of 1004 Martin Luther King Drive, West Point, Georgia 31833.
The debts secured by said Se- curity Deed have been and are hereby declared due because of, among other possible events of default, non-pay- ment of the obligations se- cured by said Security Deed. The debts remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
Said property will be sold as the property of EDDIE MC- CARDEN, subject to all presently and past due real es- tate taxes and penalty and in- terest thereon; and all other easements, security interests, liens, estates, conditions, cov- enants and restrictions of re- cord, if any, having priority over this Deed to Secure Debt. The sale will be conducted subject to (1) confirmation that the sale is not prohibited un- der the U.S. Bankruptcy Code and (2) final confirmation and audit of the status of the loan with the holder of the security deed.

The above described parcel con- tains 1.126 acres, more or less, and is shown on a plat of survey prepared by William L. Morkes, Georgia Registered Land Surveyor 2211, dated Ju- ly 24, 2002, a copy of said plat being attached hereto and made a part hereof.
