Under and by virtue of the power of sale contained in a Security Deed from LAURA FRAZIER to MORTGAGE ELECTRONIC REGISTRA- TION SYSTEMS, INC., AS NOMINEE FOR AMERICA S WHOLESALE LENDER, dated SEPTEMBER 28, 2006, recor- ded October 9, 2006, in Deed Book 1365, Page 835, Troup County, Georgia records, as assigned by Assignment to THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATE- HOLDERS OF THE CWABS, INC., ASSET-BACKED CER- TIFICATES, SERIES 2006-20, recorded on October 27, 2011, in Deed Book 01627, page 207, Troup County, Georgia records, said Security Deed being given to secure a Note from Laura Frazier of even date in the original principal amount of SEVENTY-SIX THOUSAND NINE HUNDRED AND NO/100 ($76,900.00) Dollars, with interest from date at a rate per cent per annum on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash be- fore the Courthouse door at Troup County, Georgia, within the legal hours of sale on the first Tuesday in September, 2012, the following described property:
All that tract or parcel of land situate, lying and being on the East side of South Greenwood Street, in the City of LaGrange, Troup County, Georgia, and being a portion of Lots 16, 17, and 18 of Block C of the F.E. Callaway Property as shown by a plat of said property recor- ded in Deed Book 4, page 126, Troup County records and more particularly described as follows: Beginning at the Southwest corner of Lot 16 in Block C and running thence North along the West bound- ary line of said Lot 16, a dis- tance of 90 feet to a point, run- ning thence East and across Lots 16, 17 and 18, a distance of 148.7 feet to the East boundary of Lot 18; running thence South along the East boundary line of said Lot 18, a distance of 89.7 feet to the southeast corner of said Lot 18; running thence West along the South boundary lines of Lots 18, 17, and 16, a dis- tance of 148.7 feet to the point of beginning, and being known as 613 South Greenwood Street, according to the present system of numbering property in the City of LaG- range, Troup County, Georgia. Subject to all Easements and restrictions of record, if any. The debt secured by said Se- curity Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Se- curity Deed. The debt remain- ing in default, this sale will be made for the purpose of pay- ing the same and all expenses of this sale, as provided in the Security Deed and by law, in- cluding attorney's fees (notice of intent to collect attorney's fees having been given).
Said property will be sold sub- ject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspec- tion of the property, any as- sessments, liens, easements, encumbrances, zoning ordin- ances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and be- lief of the undersigned, the party in possession of the property is LAURA FRAZIER or a tenant or tenants.
