(hereinafter re- ferred to as the Lender ), dated August 13, 2009; recor- ded in Deed Book 1544 Page 422, Troup County, Georgia records; said Security Deed having been given to secure a promissory note dated August 13, 2009, in the original prin- cipal amount of $74,948.30 (hereinafter referred to as the Note ), there will be sold by the Lender at public outcry, during the legal hours of sale before the door of the Court- house of Troup County, Geor- gia, on September 4, 2012, to the highest and best bidder for cash, the following described property:<br /><br />For a point of commencement, begin at the intersection of the North right of way of Davidson Street and the West right of way of Avenue N ; thence along the right of way of David- son Street, North 86 degrees 09 minutes 39 seconds West a distance of 62.77 feet to an iron pin and the beginning point of the property herein to be described; FROM SAID POINT OF BEGINNING; con- tinue North 86 degrees 09 minutes 39 seconds West a distance of 9.20 feet to a point; thence North 87 degrees 06 minutes 54 seconds West a distance of 40.62 feet to an iron pin; thence North 02 de- grees 18 minutes 38 West a distance of 77.55 feet to an iron pin for a corner; thence North 88 degrees 39 minutes 37 seconds East a distance of 26.74 feet to a 1 2-inch capped rebar; thence North 88 de- grees 39 minutes 37 seconds east a distance of 22.89 feet to an iron pin for a corner; thence South 02 degrees 18 minutes 07 seconds East a distance of 81.37 feet to an iron pin for a corner and the beginning point. A plat of the above described property along with other prop- erty was prepared by B. Shawn Gray, Georgia Regis- tration Number 2879, dated April 28, 2008, which is made a part hereof by reference. This being the same property which is described in that cer- tain deed which is recorded in Deed Book 1481, Page 139, in the Office of the Clerk of the Superior Court of Troup County, Georgia.<br /><br />To the best knowledge and be- lief of the undersigned the ad- dress of the above described property is 1213 Davidson Street, West Point, Georgia 31833.<br /><br />The debt secured by said Se- curity Deed and Note has been and is hereby declared due and payable in full because of, among other possible events of default, the failure of the Grantor to make principal and interest payments pursuant to the terms of said Security Deed and Note. Notice has been given of intention to en- force provisions for collection of attorney's fees and foreclos- ure in accordance with legal requirements and the terms of the Security Deed and Note. The indebtedness remaining in default, the sale will be made for the purpose of applying the proceeds thereof to the pay- ment of the indebtedness se- cured by the Security Deed, accrued interest and ex- penses of the sale and other sums secured by the Security Deed including attorney's fees, and the remainder, if any, shall be applied as provided by law. To the best of the Lender's knowledge and belief the prop- erty is in the possession of Sandra Lee Scott and said property will be sold as the property of Sandra Lee Scott subject to any prior security deed, liens, outstanding ad valorem taxes, street improve- ments, and easements or re- strictions of record, if any. The Lender will execute a deed to the purchaser at said sale as provided in the Security Deed.
