NOTICE OF SALE UNDER POWER

GEORGIA, TROUP COUNTY Under and by virtue of the Power of Sale contained in a Security Deed given by Canaan Holdings, Inc. to The First National Bank of Barnes- ville recorded in Deed Book 1327, Page 668 et. seq. Troup County, Georgia Records as transferred and assigned to United Bank from Federal De- posit Insurance Corporation, as Receiver of The First Na- tional Bank of Barnesville, as more properly reflected in the Assignment of Promissory Note and Security Deed recor- ded in Deed Book 1595, Page 466 et. seq., Troup County, Georgia Records, said Secur- ity Deed being to secure a Promissory Note in the origin- al principal amount of One Hundred Thousand and 00/100 Dollars ($100,000.00) there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Troup County, Georgia within the leg- al hours of sale on the first Tuesday in September, 2012, the following described prop- erty:

All that tract or parcel of land situate, lying and being in the City of West Point, Troup County, Georgia, being Part of Lot 3, Block 17, as more partic- ularly shown on that certain plat of survey prepared by Joe D. McElvy, GRLS 1822, dated October 3, 1994, entitled Sur- vey for WestPoint Stevens , as recorded in Deed Book 681, Page 712, Troup County, Georgia Deed Records; said plat being incorporated herein and made a part hereof for the purpose of a more complete and accurate description.

The debt secured by said Se- curity Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Se- curity Deed. The debt remain- ing in default, this sale will be made for the purpose of pay- ing the same and all expenses of this sale, as provided in Se- curity Deed and by law, includ- ing attorney s fees (notice of intent to collect attorney s fees having been given). Said prop- erty will also be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an ac- curate survey and inspection of the property, any assess- ments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of re- cord superior to the Security Deed first set out above.

To the best knowledge and be- lief of the undersigned, the party in possession of the property is Canaan Holdings, Inc. or tenants and the prop- erty has an address of 409 W. 10th Street West Point, Geor- gia 31833. The individual who shall have full authority to ne- gotiate, amend and modify all terms of the mortgage with the debtor is Kathy Pippin, United Bank, P.O. Box 340, Barnes- ville, GA 30204, (770) 412- 4941. Nothing in O.C.G.A. 44 -14-162.2 shall be construed to require this lender to negotiate, amend or modify the terms of the mortgage.
