ORDER OF THE ELECTION SUPERINTENDENT, FAYETTE COUNTY, GEORGIA, TO REGULATE AND PROVIDE FOR THE CALLING OF AN ELECTION TO DETERMINE THE CONTINUATION OF A ONE PERCENT SALES AND USE TAX AUTHORIZED BY ARTICLE 3 OF CHAPTER 8 OF TITLE 48 OF THE OFFICIAL CODE OF GEORGIA ANNOTATED; AND FOR OTHER PURPOSES:
WHEREAS, the Board of Education of Fayette County (the ayette Board of Education has furnished the Election Superintendent of Fayette County (the lection Superintendent , with a certified copy of its resolution adopted May 21, 2012 (the chool District Resolution calling an election pursuant to Sections 48-8-140, \ dq. and 48-8-111, et q., of the Official Code of Georgia Annotated, as amended, to determine whether a one percent sales and use tax as authorized by Article 3 of Chapter 8 of Title 48 of the Official Code of Georgia Annotated shall be continued for the purposes set forth in the School District Resolution; and has requested that the Election Superintendent join the Fayette Board of Education in the call of the election for such question on November 6, 2012.
NOW, THEREFORE, BE IT ORDERED that there be and there is hereby called to be held in all the voting precincts in Fayette County School District (which embraces all of Fayette County) on the 6th day of November, 2012, an election by the qualified voters of said School District to determine whether a one percent sales and use tax as authorized by Article 3 of Chapter 8 of Title 48 of the Official Code of Georgia Annotated shall be continued for a period of time not to exceed five years (20 calendar quarters), commencing upon the expiration of the current tax, to raise not more than $107,000,000 of net proceeds by said tax, which shall go to the School District for the purpose of (i) paying a portion of the principal and interest due on School District Series 2005, 2007 & 2009, the maximum of amount of total debt service to be paid shall not exceed $10,000,000; (ii) adding to, renovating, repairing, improving, and equipping existing school buildings and school system facilities, including but not limited to, paving, drainage systems, fencing, playground equipment, flooring, painting, HVAC, electrical wiring, lighting, plumbing, suspended ceiling systems, roofing, and physical education/athletic facilities; (iii) acquiring miscellaneous new equipment, fixtures and furnishings for the school system, including technology equipment and software, safety and security equipment; and (iv) acquiring textbooks and instructional materials, including digital content and curriculum software, and instructional equipment, including but not limited to computing devices, audio/visual equipment, interactive classroom equipment: (v) acquiring school buses and transportation and maintenance equipment: (vi) paying expenses incident thereto, the maximum amount sales and use tax proceeds to be spent on projects (i) through (vi) shall not exceed $107,000,000.
The several places for holding said election shall be at the regular and established voting precincts of the election districts of Fayette School District and the polls will be open from 7:00 a.m. to 7:00 p.m. on the date fixed for the election.
The last day to register to vote in this election shall be October 9, 2012, through 5:00 p.m.
BE IT FURTHER ORDERED that such election be conducted pursuant to the applicable laws of the State of Georgia, that managers and election officials for all voting precincts be appointed and that election returns be consolidated in the presence of the Election Superintendent and that the result be declared, all as is provided by law.
