NOTICE OF SALE UNDER POWER

STATE OF GEORGIA

COUNTY OF MONTGOMERY

Under and by virtue of a Power of Sale in a certain Deed to Secure Debt from Gregory A. Gordon, Grantors, to 1st Franklin Financial Corporation, dated December 16, 2005, recorded at Deed Book 189, Pages 343-345, Montgomery County, Georgia, records, in the sum of $9,837.67 there will be sold by the undersigned at public outcry, during the legal hours of sale before the courthouse door of the Courthouse of Montgomery County, Georgia, on the first Tuesday in February 2013, to wit: February 5, 2013 to the highest and best bidder for cash, the following described property:

All that tract or parcel of land, situate, lying and being in the 1810th G.M. District of Montgomery County, Georgia, containing one (1.0) acre, known as Lot Number Ten (10) of the Avant Layout as shown on a plat made by John E. Dykes, Registered Surveyor, dated January 22, 1971 and recorded in Plat Book 3, Page 6, in the Office of the Clerk of the Superior Court of Montgomery County, Georgia, which plat and the record thereof are incorporated herein by reference and made a part of this description. Said tract is the same as conveyed by Johnnie T. Smith and Larry Tanner to Gregory A. Gordon, by Quitclaim Deed, recorded in Deed Book 90, Page 207, Montgomery County deed records.

The debt secured by said Deed to Secure Debt and Note has been and is hereby declared due and payable in full because of default in payments pursuant to the terms of said Deed to Secure Debt and Note. Notice has been given of intentions to enforce the provisions for collection of attorney fees and foreclosure in accordance with the legal requirements and the terms of the Deed to Secure Debt and Note. The indebtedness remaining in default, the sale will be made for the purposes of applying the proceeds thereof to the payment for the indebtedness secured by the Deed to Secure Debt, accrued interest and expenses of the sale and other sums secured by the Deed to Secure Debt including attorney fees, and the remainder, if any, shall be applied as provided by law.

The individual that has full authority to negotiate, amend, and modify all the terms of the Deed to Secure Debt with the Debtor is 1st Franklin Financial Corporation, 71 S. Williams Street (P.O. Box 368), Hazlehurst, Georgia 31539, (912) 375-4574. Please be advised that the secured creditor is not required by law to negotiate, amend, or modify the terms of the Deed to Secure Debt or Note.

To the best of the undersigned knowledge and belief, the property is owned by Gregory A. Gordon and/or his estate and said property will be sold as the property of Gregory A. Gordon subject to outstanding ad valorem taxes, street improvements, and easements or restrictions of record, if any. The undersigned will execute a deed to the purchaser at said sale as provided in the Deed to Secure Debt.
