By virtue of the power of sale contained in that certain Deed to Secure Debt from Freddie Giddens, Sr. to Altamaha Bank & Trust Company filed for record, and recorded in Deed Book 186, Pages 547-549, Montgomery County, Georgia Records, said Deed to Secure Debt having been given to secure a Note dated September 13, 2005, and said note or the renewal thereof now being in default there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door in Mount Vernon, Montgomery County, Georgia, within the legal hours of sale on the first Tuesday in February, 2013, the property described as:

All that tract or parcel of land situate, lying and being in the Town of Uvalda, in the 1810th G.M. District of Montgomery County, Georgia, and being known and designated as Lot No. Six (6), in Block No. Seventeen (17), as shown on a plane of said Town, fronting sixty-six (66) feet on Myrtle Street, and extending back a distance of one hundred fifty-five (155) feet to an alley, and is bounded, now or formerly, as follows: North by an alley; East by land of Glen Farmer; South by the right-of-way of Myrtle Street; and West by land of Cheyenne Reges. Said tract is the same tract as conveyed to Freddie Giddens, Sr. From Arthur Ward Schmidt, III, by Warranty Deed, recorded on August 31, 2005, in Deed Book 186, Pages 194-195, in the Office of the Superior Court of Montgomery County, Georgia.

The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments and lack of insurance on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.

A copy of this legal advertisement (Notice of Sale Under Power) which was sent to the Montgomery Monitor has been mailed by certified mail, return receipt requested to Freddie Giddens, Sr. if required by Georgia Law, O.C.G.A. 44-14-162.2 and 44-14-162.3.

Said property will be sold as the property of Freddie Giddens, Sr. subject to any and all unpaid taxes, assessments, general subdivision restrictions, if any, and other restrictions and easements of record, if any; and to the best knowledge and belief of the undersigned, Freddie Giddens, Sr. is in possession of said property.

The proceeds of the sale will be used as follows:

(a) To pay the expense of said sale;

(b) To pay the sum secured by said deed;

(c) The balance to as provided by law.

This law firm is attempting to collect the debt described above, and any information obtained will be used for that purpose.
