Under and by virtue of the Power of Sale contained in that certain Real Estate Deed to Secure Debt given by James Russell Pounds ("Grantor") to Central Bank of Georgia dated October 24, 2006 and recorded November 1, 2006 in Deed Book 155 Page 347 Taylor County, Georgia official records, as modified, amended or affected by that certain Modification of Deed to Secure Debt given by Grantor dated September 12, 2009, and recorded January 8, 2010, in Deed Book 173, Page 817, Taylor County, Georgia official records, as affected by that certain Quit-Claim Deed from Central Bank of Georgia to Grantor recorded September 18, 2008 at Deed Book 166, Page 751, Taylor County, Georgia official records (together with any and all other modifications and amendments hereinafter collectively referred to as the "Security Deed"), conveying the property described below to secure repayment of that certain Note executed by Grantor and being in the original principal amount of Five Hundred Twenty Thousand Three Hundred Twenty-Four and 37/100 Dollars ($520,324.37) (together with any and all amendments, modifications, extensions, and renewals, and together further with interest thereon as described therein, collectively hereinafter referred to as the "Secured Indebtedness"), said Security Deed and Secured Indebtedness having previously been assigned to Ameris Bank ("Lender") by the Federal Deposit Insurance Corporation as Receiver for Central Bank of Georgia, there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Taylor County, Georgia, within the legal hours of sale on February 5, 2013 the following described parcel of real property together with all improvements, fixtures, easements, hereditaments, rights, members, and appurtenances located thereon and described in the Security Deed:
All that tract or parcel of land lying and being in Land Lots 169 and 170 of the 13th Land District, Taylor County, Georgia, consisting of 279.539 acres, more or less, and being more specifically described as Parcel 4 on a certain plat of survey entitled "Boundary Line Survey for Citizens State Bank" prepared by Thomas W. Futral, III, Georgia Registered Land Surveyor No. 1202, and recorded in Plat Book 4, page 270, Taylor County Deed Records. The metes and bounds contained on such plat of survey are incorporated herein by this reference for a more complete description of said property.
The Secured Indebtedness has been and is hereby accelerated and declared due because of, among other possible events of default, failure to pay the Secured Indebtedness as and when due and in the manner provided in the instruments evidencing the Secured Indebtedness and Security Deed. The Secured Indebtedness remaining in default, the sale will be made for purposes of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (written notice of intent to collect attorney's fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the Security Deed.
To the best knowledge and belief of the undersigned, the party in possession of the property is the Grantor or a tenant or tenants claiming through it.
