NOTICE OF FORECLOSURE

GEORGIA, PUTNAM

COUNTY.

Default having been made in the payment of a loan secured by deed to secure debt executed by Barbara B. Lovejoy to Bank of Hancock County dated March 17, 1989, recorded in the Office of the Clerk of Superior Court of Putnam County, Georgia, in Deed Book 7-P, Page 615, transferred and assigned to Priscilla L. Haywood (now Priscilla L. Flemister) and Ben H. Lovejoy and the undersigned having declared the full amount of the loan with interest and advances made by the undersigned due and payable on account of such default, the undersigned will, acting under the power of sale contained in said deed, on the first Tuesday in December, 2009, to-wit: December 8, 2009, between the legal hours of sale before the courthouse door of said county sell at public outcry to the highest bidder for cash the following property, to-wit:

All of that tract or parcel of land situate, lying and being in the 2nd Land District, 312th G.M.D. of Putnam County, Georgia, containing of the whole of Lot Number One Hundred Thirteen (113) as shown on that certain property survey prepared for Owens-Illinois Development Corporation by Charles William Chuck Roberts, revised April 7, 1978, recorded in the Office of the Clerk of Superior Court of Putnam County, Georgia, in Plat Book 9, Page 9, said lot containing 2.16 acres, more or less. Said property is further described as that same property conveyed from Charles W. Paige and Mary E. Paige to Barbara Braxley dated October 26, 1983, of record in Deed Book 5-W, Page 400.

The proceeds of said sale will be applied as provided in said security deed, and the undersigned will execute a deed to the purchaser at said sale as authorized by said security deed.

Notice has been given of intention to enforce provisions for collection of attorney's fees and foreclosure costs in accordance with legal requirements and the term of the above-described note and deed to secure debt.

The property will be sold subject to:

(a) any and all unpaid taxes including those accruing for the current year;

(b) any and all restrictions and easements and other matters of record affecting said property;

(c) any matters which might be disclosed by an accurate survey and inspection of the property;

(d) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code.

To the best knowledge and belief of the undersigned, the party in possession of the property is Debra Rivers, 144 Napier Mill Road, Eatonton, GA 31024 and said property is located on 104 Blue Branch Road, Eatonton, GA .
