NOTICE OF FORECLOSURE
GEORGIA, PUTNAM COUNTY:
Default having been made in the payment of a loan secured by a deed to secure debt executed by Sidney W. Kennedy, Jr. and Gwendolyn A. Kennedy to The Peoples Bank, dated December 22, 2008, and recorded in the Office of the Superior Court of Putnam County, Georgia, in Deed Book 656, pages 738-741, and such default having continued for more than thirty (30) days the undersigned having declared the full amount of the loan with interest and advances made by the undersigned due and payable on account of such default, the undersigned will, acting under the power of sale contained in said deed, on the first Tuesday in March 2013, at 10:00 o'clock a.m. or as soon thereafter as practicable during the legal hours of sale before the courthouse door of said county sell at public outcry to the highest bidder for cash the following property:
All that tract or parcel of land, lying and being in the 308th GMD, Putnam County, Georgia, being designated as Lot 10, containing 0.79 acres, more or less, as shown on a plat prepared by American Testing Laboratories, Inc., dated July 7, 1983 and recorded in Plat Book 11, page 173, Clerk's Office, Putnam County Superior Court and by reference said plat is made a part of this description. This is the same property conveyed in Deed Book 179, page 49, said Clerk's Office.
The debt secured by said Deed to Secure Debt and Note has been and is hereby declared due and payable in full because of non-payment pursuant to the terms of said Deed to Secure Debt and Note. Notice is being given as required by the provisions of Georgia Code Section 44-14-162.2 et.seq..
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U. S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
The above described real property will be sold to the highest and best bidder for cash as the property of Sidney W. Kennedy, Jr. and Gwendolyn A. Kennedy, the proceeds to be applied to the payment of said indebtedness, attorney's fees, and the lawful expenses of said sale, all as provided in the Note and Security Deed, and the undersigned will execute a deed to the Purchaser at said sale as authorized by said Security Deed.
The sale shall be subject to the following: all outstanding ad valorem taxes and/or assessments, if any; all prior assessments, easements, restrictions or matters of record; and possible redemptive rights of the Internal Revenue Service, if any.
To the best of the undersigned's knowledge and belief, the real property is presently owned by Sidney W. Kennedy, Jr. by reference to a Warranty Deed, dated 09/14/2012 and recorded in Deed Book 761, page 167, Clerk's Office, Putnam County Superior Court.
To the best of the undersigned's knowledge and belief, the party in possession of the real property is Sidney W. Kennedy, Jr. and tenants holding under him.
