Because of default in the payment of a loan secured by a deed to secure debt executed by Manuel Meza, Zab Mandez & Juan Josue Blanco to First Georgia Banking Company, dated August 25, 2006, recorded September 7, 2006 in Deed Book 611, Page 602, modification recorded in Deed Book 633, Page 445; Deed Book 672, Page 750; and Deed Book 703, Page 602, now having been assigned to CertusBank, N.A. by Receiver's Assignment of Loan Documents recorded in Deed Book 773, Page 193, and an Assignment of Leases and Rents recorded in Deed Book 703, Page 606, Murray County Superior Court, the undersigned has declared the full unpaid amount of the indebtedness referred to due and payable, and, acting under the power of sale contained in said deed, for the purpose of paying said indebtedness, will on the first Tuesday in January, 2013, during the legal hours of sale at the courthouse in said County, sell at public outcry to the highest bidder for cash, the lands described in said deed, to-wit:\

A certain tract or parcel of land lying and being in Murray County, Georgia, being part of Lots 11 and 12 of the E. U. Burger Subdivision, in Land Lot No. 186 in the 9th District and 3rd Section of Murray County, Georgia, as recorded in Plat Book No. 2, page 17, in the office of the Clerk of the Superior Court of said County, and more fully described as follows: THE BEGINNING point of said property to be 636.5 feet to the north of the south line of Land Lot No. 186 where said lands join the east side of Free Hope Road; thence in a northeasterly direction along the east side of Free Hope Road a distance of 88.5 feet; thence east a distance of 333.2 feet; thence south 4 degrees 30 minutes west a distance of 25 feet; thence east a distance of 1449.6 feet to the northeast corner of Lot No. 12 of E. U. Burger Subdivision; thence south 97.5 feet; thence west 1452 feet; thence north 4 degrees 30 minutes east a distance of 37.5 feet; thence north 89 degrees 25 minutes west to the Beginning Point.\

LESS AND EXCEPT the following described property.\

Tract \'d2A\'d3 and Tract \'d2B\'d3, according to a plat of survey prepared by Leon Pritchett, Murray County Surveyor, dated May 26, 1987, recorded May 27, 1987, in the Office of the Clerk of the Superior Court of Murray County, Georgia, in Plat Book No. 18, Page 111, and said plat and the description set out therein are by reference incorporated herein for a more particular description of said lands. Said lands are situated in Land Lot 186 in the 9th District and 3rd Section of Murray County, Georgia, and are part of the E. U. Burger Subdivision, a plat of which is of record in Plat Book No. 2, Page 17, Murray County Clerk's office.\

Notice has been given by certified mail to the debtor in compliance with OCGA 44-14-162, et seq. \

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, boundary line agreements, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. Said property also sold subject to the rights of tenant(s) in possession, if any, and all parties claiming by, through or under said tenant(s).\

Specific exception: Right of way deed recorded in Deed Book 92, Page 564, Murray County, Georgia, Public Deed Records.\

It is believed by the undersigned that the person in possession of such property is Manuel Meza, or other tenant(s).\

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.\

The undersigned will execute a deed to the purchaser as authorized by the aforementioned loan deed.\

The following information is being provided in accordance with OCGA \'a4 44-14-162.2. CertusBank, N.A., as assignee of the Federal Deposit Insurance Corporation, as receiver for First Georgia Banking Company, is the secured creditor under the security deed or deed to secure debt and loan being foreclosed. The following entity shall have full authority to negotiate, amend, and modify all terms of the above-described security deed and associated note(s) on behalf of the secured creditor: CertusBank, N.A., as assignee of the Federal Deposit Insurance Corporation, as receiver for First Georgia Banking Company, P.O.
