By virtue of Power of Sale contained in a Security Deed from TIMOTHY W. SHELLHOUSE AND ANGELA L. SHELLHOUSE to CHARLES M. THARPE dated February 1, 2012 recorded in Deed Book 202 Page 416 of the records of Clerk of Superior Court, Marion County, Georgia. Said Security Deed being given to secure a note of even date in the original principal sum of Forty-Nine Thousand Five Hundred Dollars ($49,500.00) there will be sold by the undersigned before the courthouse door in Marion County, Georgia within the legal hours of sale, on the first Tuesday in September, 2012, the following described property, to-wit:
All that tract or parcel of land lying and being in Land Lot 26 of the 11th Land District, Marion County, Georgia and further identified as Lots 62 and 63 containing 2.000 acres and having such shape, size, metes, bounds, courses and distance as are shown upon a plat thereof of Marion County Mobile Estates by Paul H. Johnson, Jr., Georgia Registered Surveyor No. 2091, dated April 16, 1996 and recorded in Plat Book F, Page 80 Clerk Office, Marion County Superior Court. Reference is hereby made to said plat and incorporated herein for the purpose of a more particular and accurate description of the property herein conveyed.
Said conveyance is subject to all rights of way, easements, and restrictions on record.
Located on this real estate is a manufactured (mobile) home described as follows: One 1997 Homestead-Southern Charm Mobile Home Manufacturer ID number HMST11907ABGA. This mobile home has been or will be modified to become a permanent structure attached to the real estate and to be considered a part of the real estate. By the execution and acceptance of this document, the grantor hereto agrees that this manufactured (mobile) home will become permanently affixed and a part of the real estate and title and ownership of the manufactured (mobile) home shall then pass with the real estate.
Also included is a perpetual non-exclusive easement for purposes of ingress and egress along the 40 foot road known as Sunnyside Drive, as shown on above referred to plat of survey.
Said conveyance is subject to those Restrictive Covenants for Marion County Mobile Estate Subdivision recorded in Deed Book 112, Pages 34-36, Marion County Deed Records.
Which has the property address of 242 Sunnyside Dr., Box Springs, GA 31801.
The debt secured by said security deed has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for then purpose of paying the same and all expenses of this sale, including attorney fees.
Said property will be sold as the property of TIMOTHY W. SHELLHOUSE AND ANGELA L. SHELLHOUSE subject to ad valorem taxes and/or assessments and other liens of record, if any.
