NOTICE OF HEARING FOR JUDICIAL IN REM TAX FORECLOSURE A Petition for Judicial In Rem Tax Foreclosure has been filed in the Superior Court of Houston County, Georgia, in accordance with O.C.G.A. 48-4-75 et seq., the City of Warner Robins Resolution dated July 7, 2008, and Article IV, Section 58-81, et. seq. of the Houston County Code, by Alton Mattox in his official capacity as City Clerk of Warner Robins and Mark Kushinka in his official capacity as Houston County Tax Commissioner. Freeman Colbert, Jr. is the record owner of the real property known as tax parcel 0W007B-20H000, 1400 S. Davis Drive, and described as follows: All that tract or parcel of land situate, lying and being in the City of Warner Robins and in Land Lot 197 of the Fifth Land District of Houston County, Georgia, being Parcels E and F, as shown on a plat of survey by Theodore W. Waddle, dated September 12, 1994, and recorded in Plat Book 46, page 112, Clerk's Office, Houston Superior Court. Said plat is incorporated herein by reference thereto for all purposes. Parcels E and F are part of the same property conveyed from Beatrice R. Childs to Freeman Colbert, Jr. by a Warranty Deed dated November 2, 1970, and recorded in Deed Book 408, page 36, Clerk's Office, Houston Superior Court. Parcel E is the same property conveyed from The City of Warner Robins, Georgia to Freeman Colbert, Jr. by a Quitclaim Deed dated November 28, 1994, and recorded in Deed Book 1126, page 784, said Clerk's Office. On July 26, 2012, a petition was filed in Houston County Superior Court seeking foreclosure of the ad valorem tax lien(s) for the City of Warner Robins for the years 2009 through 2011 in the amount of $1,812.91, and for Houston County for the years 2009 through 2011 in the amount of $1,017.45, as of July 26, 2012. Pursuant to O.C.G.A. 48-4-79(a) a hearing shall be held on the 4th day of September, 2012, at 1:30 O'clock p.m. in Court Room 2 of the Houston County Courthouse, 201 Perry Parkway, Perry, Georgia, wherein all interested parties may intervene before this Court for this purpose of opposing the granting of the Petition and issuance of an Order and Judgment allowing for sale of the above listed property for delinquent ad valorem taxes pursuant to O.C.G.A. 48-4-75 et. seq., and to show cause as to why this Court should not grant such Petition as entered by Alton Mattox, City Clerk of Warner Robins, and Mark Kushinka, Houston County Tax Commissioner, and relief prayed for therein.
