NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Publication Date: August 14, 2012 Name of Responsible Entity: City of Gainesville Address: 300 Henry Ward Way P.O. Box 2946 Gainesville, GA 30503 Phone Number: 770-531-6581 On or about at least one day after the end of the comment period, the City of Gainesville will submit a request to the Georgia Department of Community Affairs (DCA) a Certification and Request for Release of Funds (RROF) relating to a grant of federal funds made by the State of Georgia under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as: Project Name: City of Gainesville Down Payment Assistance and Homeowner Rehabilitation Project Project Description: Provide Down payment assistance to nine (9) LMI homebuyers and provide rehabilitation assistance to (8) homeowners. This is a multiyear project 2012 to 2014 where the City will be carrying out various individual actions on single family homes. The project area is described as the City of Gainesville's Census tract 6, 8, 9, and 11. It is the City's policy to exclude homes in the 100 year floodplain. The activities include: Down Payment Assistance will be provided to nine (9) households using a single, flat dollar amount of assistance to each home buyer. The funds will be provided to assist low and moderate income, first-time home buyers with the purchase of a home within specific targeted areas in the City of Gainesville City of Gainesville will provide Housing Rehabilitation assistance to eight (8) homeowners of owner-occupied, site-built houses. Only households with incomes of <50% AMI will be assisted. Total CHIP grant funds for housing rehabilitation will be $241,500. Program CDBG HOME NSP 2012 80,000.00 2013 170,000.00 2014 50,000.00 The actual amounts will be described in the annual action plan. This Environmental Review Record is valid for a period of three years: August 2012 to July 2015. The geographic area is described as City of Gainesville Census tract 6, 8, 9, and 11. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the City of Gainesville's Community Development Department located at 311 Henry Ward Way. The record is available for review and may be examined or copied weekdays between the hours 8:00 A.M. to 5:00 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Mr. Chris Davis, Housing Programs Manager, City of Gainesville Community Development Department, 311 Henry Ward Way, P.O. Box 2946, Gainesville, GA 30503. All comments must be received by close of business August 22, 2012. RELEASE OF FUNDS The City of Gainesville certifies to HUD and the Georgia Department of Community Affairs, states that C. Danny Dunagan, Jr. in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD and the Georgia Department of Community Affairs approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Name of Grantee to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD and the Georgia Department of Community Affairs, will accept objections to the City of Gainesville's request for release of funds and the certification for a period of fifteen days following the anticipated submission date of August 24, 2012 only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Name of RE; (b) the City of Gainesville has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
