NOTICE OF PUBLIC SALE
GEORGIA, TIFT COUNTY
WHEREAS, on November 10, 2009, John G. Turner, executed and delivered to Cotton Pointe Estates, LLC, a deed to secure debt conveying the following described real estate to secure payment of a promissory note of even date therewith, such deed to secure debt being recorded in Deed Book 1501, Pages 177-181, in the office of the Clerk of Tift Superior Court; and
WHEREAS, said deed to secure debt conveyed the following described real estate to secure payment of all renewal loans and advances subsequently made to John G. Turner by Cotton Pointe Estates, LLC; and
WHEREAS, Cotton Pointe Estates, LLC made a renewal loan to John G. Turner, said loan being evidenced by a promissory note; and
WHEREAS, said promissory note has become in default and Cotton Pointe Estates, LLC has exercised its option to declare the entire unpaid balance of principal and interest on said note immediately due and payable in accordance with the provisions of said note and deed to secure debt.
NOW THEREFORE, in accordance with the provisions of such note, deed to secure debt and applicable laws of the State of Georgia, Cotton Pointe Estates, LLC will offer the following described real estate for sale to the highest bidder for cash before the courthouse door in Tifton, Tift County, Georgia, between the legal hours of sale on Tuesday, September 14, 2012:
All that certain tract or parcel of land being located in Land Lots 330 and 361 in the 6th Land District of Tift County, Georgia, and being described as all of Lot 5 of Cotton Pointe Estates Subdivision, containing 3.00 acres, as shown upon a plat entitled Final Subdivision plat of Cotton Pointe Estates dated August 21, 2009, prepared by Hampton & Associates Surveying Co., recorded in Plat Book 40, Pages 122-A and 122-B, Public Records, Tift County, Georgia, and incorporated herein by reference.
Also conveyed herewith is one 1998 Peach State manufactured home, Serial No. PSH2GA20656A and PSH2GA2056B, which is located on the above described property.
Said property has the street address of 75 Cotton Pointe Circle, Tifton, Georgia 31794.
Such sale may be continued from day to day until concluded. Cotton Pointe Estates, LLC reserves the right to postpone such sale, to reject any and all bids, and to bid at such sale. The proceeds of such sale will be applied first to the indebtedness covered by such security deed and then to pay the expenses of these proceedings and the remainder, if any, will then be paid to those persons or entities entitled thereto.
Such sale shall also be subject to easements and restrictions upon such property, if any, and subject to state and county taxes for the year 2012, and previous years, if unpaid.
