NOTICE OF PUBLIC SALE
GEORGIA, TURNER COUNTY:
WHEREAS, HINDU SANATAN DHARMA SEVA MANDAL, INC. (Grantor) did as Grantor on March 2, 2010, execute to HAZEL CLEMENTS SEARCY a Security Deed conveying the following property:
All that tract or parcel of land lying and being in Land Lots 8 and 20 in the Sixth Land District of Turner County, Georgia, containing 66.42 acres, more or less, and being more particularly delineated on that plat of survey entitled urvey for Hindu Sanatan Dharma Seva Mandal, Inc. prepared by Sunbelt Surveyors, Inc., dated March 1, 2010, and recorded in Plat Slide B82, Page 2A, in the Office of the Clerk of the Superior Court of Turner County, Georgia. Said plat and the description thereon are incorporated herein by reference thereto. To the best knowledge and belief of the undersigned, said property has the street address of 1211 E. Inaha Road, Sycamore, Georgia 31790.
to secure payment of a note dated March 2, 2010, in the principal amount of One Hundred Seventy-Four Thousand and 00/100 DOLLARS ($174,000.00), which Security Deed is recorded in Deed Book 233, Pages 332-337, in the Office of the Clerk of Superior Court, Turner County, Georgia; and
WHEREAS, said note and indebtedness became in default and the holder thereof has exercised its option to declare the entire unpaid balance of principal and interest thereof immediately due and payable in accordance with the provisions of said note and Security Deed; and
WHEREAS, prior to the commencement of this foreclosure proceeding, the ESTATE OF HAZEL CLEMENTS SEARCY gave notice thereof to HINDU SANATAN DHARMA SEVA MANDAL, INC. and in all other respects complied with the provisions of O.C.G.A. Section 44-14-162.1 through Section 44-14-162.3;
NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that according to the terms of such Security Deed and applicable laws of Georgia and pursuant to the power of sale contained in said Security Deed, the ESTATE OF HAZEL CLEMENTS SEARCY will expose the said property for sale on the first Tuesday in September, 2012, before the courthouse door in Turner County, Georgia, between the legal hours of sale, to the highest and best bidder. The sale will be continued from day to day until concluded, and the ESTATE OF HAZEL CLEMENTS SEARCY reserves the right to reject any and all bids, to postpone such sale, and to bid at such sale.
The proceeds of the sale will be applied: first (1) to pay the indebtedness secured by such Security Deed; then (2) to pay the expenses of the foreclosure proceedings; and the remainder, if any, will be paid to the persons legally entitled thereto.
To the best knowledge and belief of the undersigned, the party in possession of the property is HINDU SANATAN DHARMA SEVA MANDAL, INC. or a tenant or tenants.
Pursuant to O.C.G.A. Section 44-14-162.2, the name, address, and telephone number of the individual or entity who shall have the full authority to negotiate, amend, or modify all terms of the above described mortgage is as follows: LYNN KELLEY, Temporary Administrator of the Estate of HAZEL CLEMENTS SEARCY, 207 E. 4th Street, Tifton, Georgia 31794, telephone 229-382-2421. The foregoing notwithstanding, notice in O.C.G.A. Section 44-14-162.2 shall be construed to require the ESTATE OF HAZEL CLEMENTS SEARCY to negotiate, amend, or modify the terms of the Security Deed described herein.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U. S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
