NOTICE OF SALE

Georgia, Ben Hill County

By the virtue of the Power of Sale

Contained in that certain Purchase

Money Deed to Secure Debt exe-

cuted and delivered by ZACHARY

D. DAVIS to WORTH MORTGAGE

CO., INC. dated July 8, 2009, and

recorded in Deed Book 739, Page

130, in the office of the Clerk of

Ben Hill Superior Court, there will

be sold at Public outcry before the

Courthouse Door in said State and

County by the undersigned, during

the legal hours of sale, on the first

Tuesday in February, 2013, to the

highest bidder for cash, the follow-

ing property to wit:

All that tract or parcel of land lying

and being in Land Lot 246 of the

4th Land District of Ben Hill County,

Georgia, and being all of Tract Ten

(10), containing 2.00 acres, Niag-

ara Road Subdivision, as said tract

is shown and delineated on that

certain plat of survey, prepared by

Atlas Surveying Co., Larry Burn-

sed, Registered Land Surveyor, #

2634 dated April 15, 2004, cap-

tioned urvey for: Worth Mortgage

Co., Inc. Said plat is recorded in

Plat Slide 665-D Ben Hill County,

Georgia Land Records. Reference

is made to said plat for the pur-

pose of incorporating the same

herein.

The debt secured by said Pur-

chase Money Deed to Secure Debt

has been and is hereby declared

due because of nonpayment of

monthly installments on said loan.

The debt remaining in default, then

said property will be sold for the

purpose of paying the indebtedness

secured by said deed, and the pro-

ceeds of said sale will be applied to

the payment of said indebtedness

and the interest and all charges

and expenses in connection with

this foreclosure as provided in said

deed, and the balance, if any will

be paid over to the person entitled

thereto.

Said sale will be made subject to

all easements and restrictions and

all other matters of record. The no-

tice required by the Official Code of

Georgia, Section

44-14-162.2 et. seq. has been

given as provided by law.
