NOTICE OF SALE
Because of default in the payment of indebtedness secured by a deed to secure debt executed by Sam Harris and Pamela Harris to Stanley K. Patrick dated September 28, 2007, securing a note in the original principal amount of $27,850.00, said security deed being recorded in the Office of the Clerk of the Superior Court of Colquitt County, Georgia in Deed Book 979, Pages 356-358, Colquitt County land records, the holder thereof, pursuant to the said Security Deed and Note creating the indebtedness thereby secured has declared the entire amount of said indebtedness due and payable.
Pursuant to the power of sale contained in said security deed, the holder of said security deed will, on the first Tuesday in September, 2012, during the legal hours of sale before the Courthouse door in Moultrie, Colquitt County, Georgia, sell at public outcry to the highest bidder for cash, the lands described in said security deed, to wit:
All that certain real estate situate and being in Land Lot Nos. 67 and 68 of the 8th Land District of Colquitt County, Georgia and being known and designated as Tract Six (6), Plantation Pines Subdivision, as said lot is shown upon a map of plat of said subdivision recorded in the Office of the Clerk of the Superior Court, Colquitt County, Georgia in Plat Book 40, Page 165.
The sale will be held subject to all outstanding and/or unpaid taxes, assessments, mineral and oil rights, easements and restrictions of record, applicable zoning ordinances, matters that would be disclosed by an accurate survey or inspection of the property, and all other liens of record that have priority over the above described security deed.
Notice has been given of intention to collect attorneys fees in accordance with the terms of the Note.
Said property will be sold as the property of Sam Harris and Pamela Harris, the property to the best information, knowledge and belief of the undersigned, being presently in their possession. The proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorneys fees, all as provided in said Security Deed, and the balance, if any, will be distributed as provided by law.
