NOTICE OF SALE



GEORGIA, THOMAS COUNTY.



WHEREAS, heretofore on August 3, 2007, Kenneth L. Hayes did execute to Thomas County Federal Savings and Loan Association, Thomasville, Georgia, a certain security deed to the following land:



All that tract or parcel of land containing 1.7 acres, more or less, lying and being in Land Lot 102 of the 13th Land District of Thomas County, Georgia, being more particularly described as follows: TO FIND THE POINT OF BEGINNING of the tract herein conveyed, commence at the intersection of the east right-of-way margin of Hill Road and run thence south 87 degrees 44 minutes 00 seconds east 676.79 feet which is the point of beginning of the tract herein conveyed. From said point of beginning run thence south 17 degrees 46 minutes 03 seconds west 10.37 feet to a point on the north right-of-way margin of Hill Road; run thence along the north right-of-way margin of said Hill Road south 87 degrees 44 minutes 00 seconds east 42.47 feet; continue along the north right-of-way margin of said Hill Road to a point having a chord bearing south 87 degrees 57 minutes 13 seconds east a chord distance of 57.2 feet; run thence north 02 degrees 16 minutes east 10 feet; continue along the north right-of-way margin of said Hill Road to a point having a chord bearing south 88 degrees 07 minutes 48 seconds east a chord distance of 214.83 feet; run thence north 17 degrees 58 minutes 11 seconds east 210.55 feet; run thence north 77 degrees 31 minutes 23 seconds west 301.97 feet; run thence south 17 degrees 46 minutes 03 seconds west 278.03 feet to the point of beginning of the tract herein conveyed. Said tract or parcel of land being more particularly described on the Plat of Survey for Chaswill, Inc. by Richard Matthews dated April 22, 1999 and recorded in Plat Cabinet 3, Page 128-B, Thomas County Land Records. Reference to said plat of survey is made to incorporate same herein by reference thereto.



The above-described property is known as 181 Hill Road, Thomasville, Georgia 31757.



WHEREAS, the security deed secures a note from Kenneth L. Hayes dated September 7, 2012 in the amount of One Hundred Twenty Four Thousand Seventy and 00/100 Dollars ($124,070.00) and all other indebtedness now or hereafter owing, all as shown by a security deed recorded in the Office of the Clerk of the Superior Court of Thomas County, Georgia, in Deed Book 1427, Page 185; and



WHEREAS, payments under said note have become in default, and the undersigned gave Kenneth L. Hayes notice of default and the right to cure notice as provided in the security deed, and the default was not cured as required, and the undersigned accelerated the debt and declared the same due, and the undersigned has elected to proceed with non-judicial foreclosure as provided for in said security deed.



NOW, THEREFORE, according to the original terms of said security deed and pursuant to the power of sale contained therein and the laws in such cases made and provided, the undersigned will expose for sale to the highest and best bidder for cash the above described property, after proper advertisement, on the first Tuesday in March, 2013 between the legal hours of sale before the Thomas County Judicial Center door at 325 N. Madison Street, Thomasville, Thomas County, Georgia.



Said property will be sold subject to taxes for the year 2013 and any prior unpaid taxes, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the security deed first set out above.



The proceeds from said sale will be used, first to the payment of said note, principal, interest and expenses and attorney's fees for which proper notice is given, and the balance, if any, delivered as provided in said security deed.
