UNDER POWER

Because of a default in the pay-

ment of the indebtedness secured

by a Security Deed executed by

Teresa Battle to Option One Mort-

gage Corporation dated May 31,

2001, and recorded in Deed Book

478, Page 11, Ben Hill County Re-

cords, said Security Deed having

been last sold, assigned, trans-

ferred and conveyed to Wells Fargo

Bank, N.A., as Trustee for Option

One Mortgage Loan Trust 2001-C,

Asset-Backed Certificates, Series

2001-C by Assignment, securing a

Note in the original principal

amount of $52,800.00, the holder

thereof pursuant to said Deed and

Note thereby secured has declared

the entire amount of said indebted-

ness due and payable and, pursu-

ant to the power of sale contained

in said Deed, will on the first Tues-

day, February 5, 2013, during the

legal hours of sale, before the

Courthouse door in said County,

sell at public outcry to the highest

bidder for cash, the property de-

scribed in said Deed, to-wit:

All that tract or parcel of land situ-

ate, lying and being within the Cor-

porate Limits of the City of Fitzger-

ald, Ben Hill County, Georgia, and

being in Original Lot of Land No.

301 in the Fourth Land District of

Ben Hill, Georgia, consisting of

0.31 acres, more or less, more par-

ticularly described according to sur-

vey prepared for Teresa Battle, by

M. Rhett Royal, Registered Land

Surveyor, dated May 25, 2011, re-

corded in Plat Slide 650-J in the

Public Records of Ben Hill County,

Georgia.

Said property is known as 914

South Sheridan Street, Fitzger-

ald, GA 31750, together with all fix-

tures and personal property at-

tached to and constituting a part of

said property, if any.

Said property will be sold subject

to any outstanding ad valorem

taxes (including taxes which are a

lien, whether or not now due and

payable), the right of redemption of

any taxing authority, any matters

which might be disclosed by an ac-

curate survey and inspection of the

property, any assessments, liens,

encumbrances, zoning ordinances,

restrictions, covenants, and matters

of record superior to the Security

Deed first set out above.

The proceeds of said sale will be

applied to the payment of said in-

debtedness and all expenses of

said sale as provided in said Deed,

and the balance, if any, will be dis-

tributed as provided by law.

The sale will be conducted subject

(1) to confirmation that the sale is

not prohibited under the U.S. Bank-

ruptcy Code and (2) to final confir-

mation and audit of the status of

the loan with the secured creditor.

The property is or may be in the

possession of Teresa Battle, suc-

cessor in interest or tenant(s).
