NOTICE OF SALE
GEORGIA, LEE COUNTY
Because of default in the payment of the indebtedness, secured by a Security Deed executed by Billie D Baggett and Casey D Baggett to Mortgage Electronic Registration Systems, Inc., as nominee for Synovus Mortgage Corp., its successors and assigns dated November 21, 2008 in the amount of $50,000.00, and recorded in Deed Book 1296, Page 302, Lee County, Georgia Records; as last transferred to JPMorgan Chase Bank, National Association by assignment; the undersigned, JPMorgan Chase Bank, National Association pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, will on the first Tuesday in December, 2012, during the legal hours of sale, at the Courthouse door in Lee County, sell at public outcry to the highest bidder for cash, the property described in said deed to-wit:
All that tract or parcel of land lying and being in Land Lot 67 in the Sixteenth Land District, City of Smithville, Lee County, Georgia, and being more particularly described as follows:
Begin at an iron pin set at the intersection of the Northern right-of-way of Whitaker Street (40 foot right-of-way) and the West right-of-way of Boulevard Avenue (50 foot right-of-way), and from said point of beginning, go thence South 88 degrees 04 minutes 50 seconds West 181.71 feet to an iron pin set; thence go North 12 degrees 15 minutes 53 seconds West 244.15 feet to an iron pin set which is on the Southern right-of-way of Cemetery Street (40 foot right-of-way); thence go North 66 degrees 56 minutes 05 seconds East 155.20 feet to an iron pin set; thence go South 17 degrees 10 minutes 45 seconds East 306.99 feet to an iron pin set and the point of beginning. This description is based on a plat entitled `Plat of Survey Property of Franklin H. Holliday and Deborah L. Holliday dated October 29, 1997, prepared by William H. Spires, Jr., Georgia Registered Land Surveyor No. 2527, a copy of which is attached hereto as Exhibit and incorporated herein for all purposes.
which has the property address of 121 Whitaker Street, Smithville, Georgia., together with all fixtures and other personal property conveyed by said deed.
The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorneys fees in accordance with the terms of the note secured by said deed. Notice has been also given, in writing and by certified mail, return receipt requested, to the borrower, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the note thereby secured in accordance with O.C.G.A. Section 44-14-162.2(a).
Said property will be sold as the property of Billie D Baggett and Casey D Baggett and the proceeds of said sale will be applied to the payment of said indebtedness, the expense of said sale, all as provided in said deed, and the undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.
