NOTICE OF SALE
GEORGIA, PUTNAM COUNTY.
By virtue of power of sale contained in Deed to Secure Debt from John F. Granich and Susan D. Granich to The Peoples Bank, dated September 7, 2006, recorded in Deed Book 565, page 346 and rerecorded in Deed Book 572, page 367, both in the Office of the Clerk of Superior Court of Putnam County, Georgia (hereinafter collectively the Security Deed ), there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door in Putnam County Georgia, within the legal hours of sale on the first Tuesday in September, 2012, the following described property:
All that certain tract or parcel of land lying and being in the 2nd Land District, 313th G.M. District, Putnam County, Georgia containing 2.29 acres, more or less, and being designated as all of Lot 8-3 on that certain plat of survey prepared for John and Susan Granich by Ogeltree and Chivers, Registered Land surveyor No. 2558, dated May 15, 2005 and recorded with the Clerk of Superior Court of Putnam County, Georgia in Plat Book 30, page 73.
PRIOR DEED REFERENCE: This lot is a combination of Lot 8-3 as described in deed from Bobby Ray Scoggins to John and Susan Granich, dated December 15, 1999, recorded in Deed Book 301, page 431, in the Office of the Clerk of Superior Court of Putnam County, Georgia and Lot 8-4 as described in deed from Bobby Ray Scoggins to John and Susan Granich, dated March 1, 1997, recorded in Deed Book 239, page 37, in the Office of the Clerk of Superior Court of Putnam County, Georgia.
The residence situated upon the above described property is known and designated as 178 Cold Branch Road, Eatonton, Georgia 31024, according to the present system of numbering houses in Putnam County, Georgia.
Together with all buildings, structures, and other improvements now or hereafter located on said property, or any part and parcel thereof.
The Peoples Bank, is the current holder and owner of the Security Deed and the promissory note secured thereby. The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay amounts due under the promissory note secured by the Security Deed when due. Said default not being cured, and the debt remaining in default, the sale will be made for the purpose of paying the same and all expenses of the sale, including accrued attorney s fees.
Said property will be sold by The Peoples Bank, as attorney in fact for John F. Granich and Susan D. Granich, subject to any outstanding ad valorem taxes and/or assessments, and matters of record, if any, having priority over the Security Deed.
To the best of the knowledge and belief of The Peoples Bank, the people in possession of above described property are John F. Granich and Susan D. Granich or persons claiming under them.
Said property will be sold and deed executed by the undersigned to the purchaser and the proceeds of sale applied by the undersigned, all as provided in said power of sale and the Security Deed containing said power.
