GEORGIA, PUTNAM COUNTY
Under and by virtue of the Power of Sale contained in a Security Deed given by GREGORY-MILLER CUSTOM HOMES, INC. to Farmers & Merchants Bank recorded in Deed Book 528, Page 759 et. seq. Putnam County, Georgia Records as subsequently modified in written Modifications recorded in Deed Book 584, Page 378 et. seq., and Deed Book 618, Page 481 et. seq. Putnam County, Georgia Records, said Security Deed being to secure a Promissory Note in the original principal amount of Nine Hundred Fifty-Eight Thousand Five Hundred Sixty-Eight and 50/100 Dollars ($958,568.50) there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Putnam County, Georgia within the legal hours of sale on the first Tuesday in March 2013, the following described property:
All that certain lot or parcel of land lying and being in the 308th G.M. District of Putnam County, Georgia, in Cuscowilla, and being more particularly described as Lot Number 14, Section B, Phase I of Cuscowilla, a planned development located in Putnam County, Georgia with such lot being more particularly shown and identified on that certain plat of survey recorded in Plat Book 25, Page 78, Clerk s Office, Putnam County Superior Court, as has been or may be amended, such plat being incorporated herein by this reference.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney s fees (notice of intent to collect attorney s fees having been given). Said property will also be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is GREGORY-MILLER CUSTOM HOMES, INC. or tenants and the property has an address of 138 Cape View Lane, Eatonton, Georgia 31024. The individual who shall have full authority to negotiate, amend and modify all terms of the mortgage with the debtor is Powell Griffith, Farmers & Merchants Bank, 1011 Lake Oconee Parkway, Eatonton, Georgia 31024, (706) 4859858. Nothing in O.C.G.A. 44-14-162.2 shall be construed to require this lender to negotiate, amend or modify the terms of the mortgage.
