Because of default in the payment of the indebtedness, secured by a Security Deed executed by Barbara E Brooksher to Mortgage Electronic Registration Systems Inc., as nominee for Home America Mortgage, Inc., its successors and assigns dated March 9, 2007 in the amount of $106,000.00, and recorded in Deed Book 589, Page 597, Putnam County, Georgia Records; as last transferred to Cenlar FSB by assignment; the undersigned, Cenlar FSB pursuant to said deed and the note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said deed, will on the first Tuesday in March, 2013 , during the legal hours of sale, at the Courthouse door in Putnam County, sell at public outcry to the highest bidder for cash, the property described in said deed to-wit:

All that tract or parcel of land, together with all permanent improvements located thereon and connected therewith, the same situate, lying and being in the 314th GMD, Putnam County, Georgia, being part of that tract of land shown on a plat by Robert H Harwell dated June 14, 1993 for Curtis J McDade and Julia W McDade recorded in Plat Book 18, Page 146, Putnam County Records, which plat is by this reference incorporated herein. The part of said tract hereby conveyed is all of said tract lying West of the boundary line with Georgia Power Company, which boundary line begins at a point on the stream branch shown on said plat at the intersection of said branch and the centerline of Rabbit Skip Spur; thence North 31 degrees 25 minutes 34 seconds West to an iron pin on the perimeter traverse shown on said plat; thence North 15 degrees 20 minutes 17 seconds West a distance of 214.15 feet to an iron pin; thence North 15 degrees 56 minutes 31 seconds West a distance of 161.83 feet, more or less, to a point on the 340 contour line; thence North 15 degrees 56 minutes 31 seconds North to the centerline of Murder Creek. Also conveyed is that triangular area shown on said plat adjacent to and East of aforesaid Georgia Power Company boundary, being 68.50 feet along said boundary, 67.70 feet on the Northeast side of the triangle, and 24.90 feet on the Southwest side of the triangle, containing .02 acres, more or less, and being that .02 acres conveyed to W.F. Resseau, Jr. by deed of Mrs. T. H. Resseau, Sr. recorded at Deed Book 3-P, Page 133, said records, and being Owens-Illinois Tract 86 shown on the plat recorded at Plat Book 2, Page 129, aforementioned Clerks Records.

The part of this tract lying West of said Georgia Power Company boundary includes (a) that land lying between the perimeter traverse shown on said plat and the centerline of Murder Creek, said land lying West of the Georgia Power Company boundary line and East of the 50.0 foot extension of the Northwest boundary line of this tract shown on said plat; and (b) that land lying between the perimeter traverse shown on said plat and the centerline of the branch shown on said plat, said land lying to the West of the Georgia Power Company boundary and lying East of that line shown on said plat beginning at an iron pin on said traverse line and then running South 32 degrees 36 minutes 43 seconds East a distance of 25.0 feet to the centerline of said branch. There is also hereby conveyed a permanent non-exclusive easement for ingress, egress and utility lines on, along and across that 50 foot wide strip of land known as Rabbit Skip Spur, beginning at the Western boundary of the tract of land first described above, thence Southwesterly along said strip of land approximately 349 feet to the intersection with Rabbit Skip Road. The centerline of said strip of land is also shown on a plat by Walker McKnight Surveyors, Inc. dated April, 1986, recorded at Plat Book 14, Page 147, Putnam County Deed Records. Said strip of land is believed to be a public road, having been conveyed to Putnam County by deed recorded at Deed Book 3-N, Page 114, but this easement is granted to assure access to the property described above. Said property is further described as that same property conveyed unto Barbara E. Brooksher by Curtis J. McDade and Julia W. McDade by Warranty Deed of even date being filed for record in said Clerk`s Office simultaneously herewith; and the same included in deed to Curtis J. McDade and Julia W. McDade from W. F. Resseau, Jr., et al dated June 23, 1993 and recorded in Deed Book 96, Pages 61- in said Clerk`s Office.

which has the property address of 567 Rabbit Skip Road, Eatonton, Georgia., together with all fixtures and other personal property conveyed by said deed.

The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property.

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.

Notice has been given of intention to collect attorneys' fees in accordance with the terms of the note secured by said deed. Notice has been also given, in writing and by certified mail, return receipt requested, to the borrower, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the note thereby secured in accordance with O.C.G.A. Section 44-14-162.2(a).

Said property will be sold as the property of Barbara E Brooksher and the proceeds of said sale will be applied to the payment of said indebtedness, the expense of said sale, all as provided in said deed, and the undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.
